ROLL CALL Present: Agency Members Pickett, Koman, Knapp, Ordiz, Prince, Takii Absent: Chair Bentley 2. PUBLIC STATEMENTS None 3. CONSENT CALENDAR a. Minutes of the October 12, 2009 regular meeting. b. Approval of department payments from October 2, REMOVED FOR 2009 to December 3, 2009 in the amount of SEPARATE $2,339,835.02. CONSIDERATION C. Amendment No. 2 to Agreement No. 05-195/RA05-002 RA05-002(2) Sub-recipient with the City of Bakersfield for the commitment of $2,046,619 Home Investment Partnership Funds earmarked for affordable housing in The Baker Street Mixed Use Project. Motion by Prince, seconded by Takii, to approve Consent APPROVED Calendar items 3.a. and 3.c. with the removal of item 3.b. for AB BENTLEY separate consideration. b. Approval of department payments from October 2, 2009 in the amount of $2,339,835.02. Motion by Prince, seconded by Takii, to approve item 3.b. APPROVED AB BENTLEY 4. PUBLIC HEARINGS None 5. REPORTS a. Update status of Baker Street Mixed Use Project. b. Update status of Proposition 1 c. C. Mill Creek Linear Park Financial update. 317 Bakersfield, California, December 14, 2009- Page 2 5. REPORTS CONT. ACTION TAKEN ED/CD Director Donna Kunz gave an overview on projects 5.a. and 5.b. Handout given for presentation on 5.c. given by Assistant ED/CD Director Rhonda Barnhard. 6. DEFERRED BUSINESS None. 7. NEW BUSINESS a. A Resolution establishing the dates of meetings for the RAO11-09 Bakersfield Redevelopment Agency for the months of January through December 2010. Motion by Ordiz, seconded by Prince to approve Resolution. APPROVED AB BENTLEY b. Agreement with Desmond, Marcello & Amster for $65,000 RA09-015 to provide additional goodwill loss appraisal services for the South Mill Creek Mixed-Use Project. ED/CD Director Donna Kunz gave staff report. Motion by Knapp, seconded by Pickett to approve the APPROVED NOES PRINCE Agreement. AB BENTLEY C. Owner Participation Agreement with Mexicali, a RA09-016 California Corporation to provide all maintenance necessary for a fapade wall and wrought iron fence located within the public right-of-way along Mill Creek Linear Park between 17th & 18th Streets. Assistant ED/CD Director Rhonda Barnhard gave staff report. ED/CD Director Donna Kunz gave additional comments. Motion by Prince, seconded by Takii to approve the APPROVED Agreement. AB BENTLEY 8. AGENCY STATEMENTS Agency Member Prince commented on what a great job Member Koman did as Vice-Chair. 9. CLOSED SESSION a. Conference with Legal Counsel - Existing Litigation Closed Session pursuant to subdivision (a) of Government Code section 54956.9 for Bakersfield Redevelopment Agency vs. Whitlock Property, LLC et al. KCSC Case No. S-1500-CV-265174 SPC 318 Bakersfield, California, December 14, 2009- Page 3 9. CLOSED SESSION CONT. ACTION TAKEN b. Conference with Real Property Negotiators pursuant to Government Code section 54956.8 regarding properties at 700 California Ave and 1231 R Street; Agency Negotiators: Finance Officer Nelson Smith and Real Property Manager Donald Anderson; Negotiation Parties: Pastor Timothy O. Coston, Sr., Cain Memorial AME Church; Under Negotiation: Price and terms of payment for purchase. Meeting recessed to Closed Session at 4:52 p.m. Motion by Vice-Chairperson Koman, to adjourn from Closed Session at 5:18 p.m. 9. CLOSED SESSION ACTION a.
