HomeMy WebLinkAboutRES NO 003-10 RESOLUTION NO. 0 0 3 - 10 A RESOLUTION OF THE BAKERSFIELD CITY COUNCIL APPROVING THE APPLICATIONS FOR GRANT FUNDS FOR THE TRANSPORTATION ENHANCEMENT PROGRAM UNDER U.S. CODE, TITLE 23, SECTIONS 104b(3) AND 133d(2) TO LANDSCAPE PORTIONS OF STOCKDALE HIGHWAY AND TO CONSTRUCT A BIKE PATH AT THE CALLOWAY WEIR AND AUTHORIZING THE PUBLIC WORKS DIRECTOR OR DESIGNEE TO EXECUTE ALL NECESSARY DOCUMENTS. WHEREAS, the Kern Council of Governments (KernCOG) has, in accordance with guidelines issued by the State of California, issued a Call for Projects under the Transportation Enhancement Program for programming projects in fiscal years 201 1-2012 and 2012-2013; and WHEREAS, KernCOG has established the procedures and criteria for reviewing grant proposals; and WHEREAS, said procedures and criteria established by KernCOG require a resolution certifying the approval of the application by the Applicant's governing body; and WHEREAS, the application contains assurances that the Applicant must comply with; and WHEREAS, the Applicant, if selected, will enter into an agreement with the State of California to carry out the transportation enhancement project; NOW, THEREFORE, BE IT RESOLVED that the Bakersfield City Council hereby: 1. Authorizes the nomination of the following two transportation enhancements for the Transportation Enhancement Program for grant assistance a. Landscape Improvements on Stockdale Highway in its north sidewalk area between McDonald Way and North Stine Road, and b. Bike Path Improvements across the Kern River at the Calloway Weir (west of Chester Avenue) to connect the Kern River Bike Path to the Riverview Park. 2. Certifies that said Applicant will make adequate provisions for operation and maintenance of the project. 3. Appoints the Public Works Director, or his designee, as agent of the City of Bakersfield to conduct all negotiations, execute and submit all documents, including, but not limited to applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned projects. or~;bAKF9 s~ G:\GROUPDAT\ADMINRPT\2010\01-13\TE Resolution.docx Page 1 of 2 ORIGINAL...
