TO 'SECTION 2.92.330 OF THE BAI'~ERSFtEL,D MU:NilCIPAL CODE RELATING TO FIRE DEPARTMENT RELIEF AND PENSIONS. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Subsection A. of Section 2.92.010 of the Bakersfield Municipal Code is hereby amended to read as follows: 2.92.010 Pension board. A. The relief and pension fund, created and established for member~ of the fire department of the city who did not join the public employees' retirement system, shall be administered by a board of trustees known as the pension board. The pension board shall consist of the mayor, city manager, finance director, chief of the fire department and three other persons elected by vote of the members of the fund. Members of the fund shall be eligible for election as members of the pension board and three other persons elected by vote of the "voting members" of the fund. SECTION 2. Subsection Y. of Section 2.92.020 is hereby added to the Bakersfield Municipal Code to read as follows: 2.92.020 Definitions. Y. "Voting member" includes a member, or, a deceased member's beneficiary spouse. The intent of this section is not to be interpreted as giving more than one vote to a family or extending voting rights to other beneficiaries of a member. SECTION 3. Subsection C. of Section 2.92.330 Of the Bakersfield Municipal Code is hereby amended to read as follows: 2.92.330 Increase in monthly allowance -- Retirements or deaths for period. C. Commencing on July 1, 1982 and every year theroafter through July 1, 1991, the schedule provided in subsection A. of this section shall be increased by a two percent cost-of-living adjustment. Commencing July 1, 1992 and every year thereafter through July 1, 1996, the schedule provided in subsection A of the section shall be increased by a three percent cost-of-living adjustmentl with monthly payments rounded to the next highest whole dollar after applying this increase. Commencing January 1, 1997 and every year thereafter, the schedule provided in subsection A. of the section shall be increased by a three and one-half percent cost-of-living adjustment with monthly payments rounded to the next highest whole dollar after applying this increase. SECTION 4.
