RESOLUTION NO. 016 - 10
A RESOLUTION DETERMINING THAT GAME
TIME 5-12 POWERSCAPE PLUS HYBRID
PLAYGROUND EQUIPMENT CANNOT BE
REASONABLY OBTAINED THROUGH THE USUAL
BIDDING PROCEDURES AND AUTHORIZING THE
FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFOR AND PURCHASE ONE
POWERSCAPE PLUS HYBRID PLAYGROUND
EQUIPMENT FROM GAME TIME, NOT TO
EXCEED $15,200.
WHEREAS, the Recreation and Parks Department has received a $10,000
contribution from Aera Energy LLC; and
WHEREAS, Aera Energy LLC selected Game Time 5-12 Powerscape Plus
Hybrid Playground Equipment as the preferred playground equipment for the Aera
Park project; and
WHEREAS, the Powerscape Plus Hybrid Playground Equipment is a patented
design by Game Time that can only be reasonably obtained from the vendor
because of the design patent; and
WHEREAS, Game Time is the manufacturer and distributor of the Powerscape
Plus Hybrid Playground Equipment.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The above-referenced playground equipment can only be
reasonably obtained from one vendor (Game Time) due to the patented design of
the preferred playground equipment for the Aera Park project.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for such equipment shall not exceed Fifteen
Thousand Two-Hundred Dollars ($15,200).
