Applicant agrees that if this application is granted, applicant shall indemnify, defend and hold harmless the City, its
officers agents and employees against any and all liability, claims, actions, causes of action or demands, whatsoever
against them, or any of them, before administrative, quasi-judicial, or judicial tribunals of any kind whatsoever, arising out
of, connected with, or caused by applicant's placement, erection, use (by applicant or any other person or entity) or
maintenance of said encroachment. The applicant further agrees to maintain the aforesaid encroachment during the life
of said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is made, if granted or upon the
revocation thereof by the City engineer, applicant will at his own cost and expense remove the same from the public
property or right of way where the same is located, and restored said public property or right of way to the condition as
nearly as that in which it was before the placing, erection, maintenance or existence of said encroachment.
Applicant further agrees to obtain and keep all liability insurance required by the City Engineer in full force and effect for
however long the encroachment remains. Applicant shall furnish the City Risk Manager with a Certificate of Insurance
evidencing sufficient coverage for bodily injury or property damage liability or both and required endorsements evidenc-
ing the insurance required. The type(s) and amount(s) of insurance coverage is:
Applicant acknowledges the right of the City Engineer, pursuant to Bakersfield Municipal Code Chapter 12.20 to revoke the permit at
any time.

Public Works staff has reviewed the Encroachment Permit complaint regarding the newly constructed block wall located at 2101
Benton Street. After site review and consultation with various City Departments, including the Attorney's Office and Development
Services, the following conclusions were reached:
1. The Encroachment Permit application indicated that the newly constructed fence would be wrought iron with block wall.
2. The drawing provided with the application did not indicate the location of the neighbor's driveway (2105 Benton Street), so it
was difficult for staff to determine if there was a line-of-sight problem prior to issuing this permit.
3. The drawing provided with the application did indicate that the corner of the new block wall shared by the property owners of
2101 Benton Street and 2105 Benton Street would have a "fence" installed that would have allowed a better line of sight for the
resident at 2105 Benton when backing out of their driveway.
4. According to the City Municipal Code 17.08.175.B, "Clear Line of Sight", the block wall, as constructed, is in violation. This code
states that there should be a 10' x 10' triangular area clear of obstructions for line-of-sight purposes at the property line abutting
alleys and driveways. However, due to the age of this neighborhood, this code has been violated at several other residences near
2101 Benton Street.
Staff recommends that the top portion of the newly constructed block wall along the property line between 2101 Benton Street
and 2105 Benton Street be removed and decorative wrought iron (similar to the existing wrought iron along the front) be installed
to allow for increased line-of-sight for the adjacent driveway.
