Their plan is to fence their parking lot and install 2 light standards to illuminate the lot. The plan is to install two light standards in existing tree wells at the back of sidewalk that do not currently contain trees. These wells measure Tx 3' and the sidewalk measures 11' from face of curb to back of walk. The curb to property distance along Eye Street in this area is 14'. Given these dimensions, I see no reason not to grant Dewars an encroachment permit. Both fence and light standards are far enough away from the street to cause no problems for traffic, either vehicular or pedestrian. Indeed, on a street with more normal curb to property dimensions, the location of the encroachment would be well withing their property line.
