RESOLUTION NO. 035-10 (1)
AMENDMENT NO. 1 TO RESOLUTION NO.
035-10 DISPENSING WITH BIDDING
PROCEDURES DUE TO EMERGENCY SEWER
REPAIRS NEAR THE INTERSECTION OF 32"D
STREET AND H STREET, NOT TO EXCEED
THREE HUNDRED TEN THOUSAND DOLLARS
($310,000.00)
WHEREAS, on March 24, 2010, City Council adopted Resolution No. 035-10
dispensing with bidding procedures for emergency sewer repairs near the
intersection of 32nd Street and H Street; and
WHEREAS, the initial estimate of the final project cost was $200,000 and was
based on an estimate that the contractor had given the City prior to any site
investigations by the contractor; and
WHEREAS, the contractor potholed fiber optic lines in the Union Pacific
Railroad right of way and the City determined that the lines were in conflict with the
proposed depth of the new sewer alignment; and
WHEREAS, the new sewer line had to be redesigned with a deeper grade to
clear the fiber optic lines, and as a result significantly more construction work is
required to complete the project; and
WHEREAS, an additional appropriation of $110,000 is needed to complete the
construction of the new sewer alignment; and
WHEREAS, the sewer line repair needs to be completed as soon as possible to
replace the failing sewer line and to preserve the public health, safety, and
welfare. Costs are estimated not to exceed $310,000.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and are incorporated herein
by reference.
2. Resolution No. 035-10 is hereby amended to increase the estimated
final project cost of construction of the emergency sewer repairs from
$200,000 to $310,000.

HEREBY CERTIFY that the foregoing Resolution was passed and adopted by
the Council of the City of Bakersfield at a regular meeting thereof held on APR 2 1, 2010
