RESOLUTION NO. 0 5 1 0
A RESOLUTION ESTABLISHING INDUSTRIAL
AND COMMERCIAL SEWER SERVICE USER
SURCHARGES
WHEREAS, Chapter 14.12 of the Bakersfield Municipal Code authorizes the
establishment and increase of fees and charges to recover costs for services
rendered; and
WHEREAS, a public hearing before the City Council was advertised twice
in the Bakersfield Californian, a newspaper of general circulation; and
WHEREAS, a public hearing was held to determine whether the proposed
fees and charges are discriminatory or excessive; and
WHEREAS, the fees and charges set forth in Exhibit "A," attached hereto
and incorporated by reference, do not exceed the reasonable estimated cost
of providing the services for which the fees are charged.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals and findings are true and correct and are
incorporated herein by reference.
2. The fees and charges set forth in Exhibit "A" are hereby adopted
and shall become effective on July 1, 2010.
3. The adoption of these fees and charges complies with Proposition
218.
4. Pursuant to the Bakersfield Municipal Code, the fees and charges
herein shall be collected by the City of Bakersfield on a monthly
basis.

HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on

INDUSTRIAL AND COMMERCIAL SEWER SERVICE USER SURCHARGES
FISCAL YEAR 2010-11
Surcharge Schedule - Commercial and Industrial
This schedule shall apply to the commercial and industrial users with
flow, BOD, and TSS greater than the Flat Rate limits. The surcharge
for the excesses shall be as follows:
Flow $1,465.84/million gallons.
Biochemical Oxygen Demand (BOD) $102.35/1,000 pound.
Total Suspended Solids (TSS) $112.22/1,000 pound.
Note- Flow will be estimated based on water
consumption records during the three (3) winter months
from December to February. This is to adjust for water
used for irrigation that will not flow into the sewer
system.
