RESOLUTION OF INTENTION NO. 1072
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DECLARING ITS INTENTION TO ORDER
THE VACATION OF THE ALLEY ON THE SOUTH SIDE
OF BRUNDAGE LANE EXTENDING WEST FROM OLIVE
STREET, IN THE CITY OF BAKERSFIELD.
WHEREAS, J. 0. Barber submitted a request for vacation of
the alley on the south side of Brundage Lane extending west from
Olive Street; and
WHEREAS, at its meeting on February 15, 1990, the request
for vacation was duly heard and considered by the Planning
Commission and was found to be consistent with the Bakersfield
Metropolitan Area General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. That it intends to order the vacation of the alley
of the alley on the south side of Brundage Lane extending west
from Olive Street, in the City of Bakersfield, County of Kern,
State of California, more particularly described in Exhibit "A"
and depicted in Exhibit "B", attached hereto and made a part
hereof. The vacation shall proceed under the provisions of
Chapter 3 of Part 3 of Division 9 of the California Streets and
Highways Code ("the Public Streets, Highways, and Service
Easements Vacation Law").
2. That the hour of 7:00 P.M. on WEDNESDAY, APRIL 18,
1990, in the Council Chambers in the City Hall, 1501 Truxtun
Avenue, Bakersfield, California, be and the same is hereby fixed
as the time and place when and where all persons interested in or
objecting to the proposed vacation may appear before the City
Council and be heard.
3. That the City Clerk shall cause notice of the date,
hour and place of hearing on this resolution to be published for
two successive weeks prior thereto in the Bakersfield Californian
and the Superintendent of Streets of the City of Bakersfield,
California, shall cause "Notice of Vacation" to be posted as
required by Section 8323 of the Streets and Highways Code of the
State of California.

4. The City Clerk shall certify to the passage of this
resolution and shall cause the same to be posted on the bulletin
board at the City Hall, 1501 Truxtun Avenue, in the City of
Bakersfield, California, within fifteen (15) days after its
passage.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on MAR 2 1 1990 by

EXHIBIT A
All of the remaining portion of the 20-foot wide Pubic alley dedicated on
Tract No. 1549 filed May 17, 1950 in Book 7 of Maps, Page 95 in the office of
the Kern County Recorder, said alley portion lying between the West right of way
line of Olive Street and the Northeasterly right of way line of the State
Freeway 99 interchange at State Freeway 58, being more particularly described as
follows:
Beginning at the point of intersection of the South line of said alley and the
West line of Olive Street as shown on Map of said Tract No. 1549;
THENCE North 89°54'40" West, along said South line, 127.63 feet to a point on
said State Freeway right of way line;
THENCE North 49019137" West, along said right of way line, 30.74 feet to a point
on the North line of said alley;
THENCE South 89°54'40" East, 151.00 feet to a point on said West line of Olive
Street;
THENCE South 00010128" East, 20.00 feet to the point of beginning.
NOTICE:
The location and description of any easements to be reserved in the above-
described parcel for public utilities or public sewer line shall be made part of
the final resolution by City Council ordering vacation of said parcel.
