AMENDMENT NO. 3 TO RESOLUTION NO. 140-08
APPROVING MEMORANDUM OF
UNDERSTANDING FOR EMPLOYEES OF THE BLUE AND
WHITE COLLAR UNITS AND ADOPTING SALARY SCHEDULE
AND RELATED BENEFITS
WHEREAS, the Charter of the City of Bakersfield, Section 12, authorizes the
City Council to provide for salaries and related benefits for officers and
employees of the City; and
WHEREAS, Resolution No. 140-08 sets salaries and related benefits for
employees of the Blue and White Collar Units; and
WHEREAS, Amendment No. 1 to Resolution No. 140-08 deleted several
class titles in both the Blue and White Collar Units; and
WHEREAS, Amendment No. 2 to Resolution No. 140-08 extended the term
of the Memorandum of Understanding for the Blue and White Collar Units;
deferred the December 21, 2009 salary increase; redefined "bumping"
procedures; and restricted mandatory furloughs for employees in these Units;
and
WHEREAS, in compliance with the Meyers-Milias-Brown Act of the State of
California, the City has met and conferred in good faith with the Service
Employees International Union (S.E.I.U.), Local 521 which represents employees
of the City's Blue and White Collar Units; and
WHEREAS, the City's negotiator and the S.E.I.U., Local 521 have agreed to
open the current MOU and have reached agreement to extend the Term of
MOU and amend the December 20, 2010 and September 12, 2011 salary
increases for said Units; and
WHEREAS, the Council has determined that the amended salary and
related proposals agreed upon by the City's negotiator and the S.E.I.U., Local
521 are acceptable.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The attached Amended and Extended Memorandum of
Understanding for the Blue and White Collar Units is hereby approved,
deferring the December 20, 2010 and September 12, 2011 salary
increases as follows:
• Extend contract to December 31, 2012 and grant a 2%
increase effective December 19, 2011 and a 2% increase
effective July 2, 2012.

AMENDMENT #2
MEMORANDUM OF UNDERSTANDING
BETWEEN
THE CITY OF BAKERSFIELD AND
SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 521
The Memorandum of Understanding (MOU) between the City of Bakersfield and Service
Employee's International Association dated January 1, 2008 through December 31, 2011,
as amended (Amendment # 1) on April 22, 2009, shall be further amended as follows.
ARTICLE 3 - TERM OF AGREEMENT
The City and the Union agree that the term of this Agreement shall commence on
January 1, 2008, and expire at 12:00 midnight on December 31, 2012.
ARTICLE 15 - COMPENSATION
For all classifications covered under the terms of this Agreement and for regular
employees actively employed at the adoption of this MOU by the City Council there will
be a salary increase of three percent (3%) paid retroactive to December 24, 2007.
Effective July 7, 2008 salary ranges shall be increased by one percent (1%). Effective
December 22, 2008, salary ranges shall be increased by four percent (4%). Effective
December 19, 2011 salary ranges shall increase by two percent (2%) and effective July 2,
2012 salary ranges shall increase by two percent (2%).

With the exception of Article 3 and Article 15, which is being further amended herein, the
MOU between the City of Bakersfield and the Service Employees International Union,
Local 521 (dated August 20, 2008) and Amendment #1 (dated April 22, 2009) remain in
full force and effect.
This AMENDMENT #2 MEMORANDUM OF UNDERSTANDING is entered into and signed this
36 day of April 2010.
