RESOLUTION NO. 0 7 7 10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD, CALIFORNIA, SETTING PRIORITIES FOR
FILING WRITTEN ARGUMENTS REGARDING A CITY
MEASURE.
WHEREAS, a General Municipal Election is to be held in the City of
Bakersfield, California, on November 2, 2010, at which there will be submitted to
the voters the following measure:
MEASURE
YES
Shall the City of Bakersfield adopt the
following law:
Effective January 1, 2011, new City of
Bakersfield sworn public safety employees will
pay 100% of their employee pension NO
contribution and be eligible for a maximum
retirement allowance with the Board of
Administration of the Public Employees'
Retirement System (PERS) at a 2% at age 50
Formula based on their average salary
calculated over 36 highest paid consecutive
months.
WHEREAS, pursuant to Election Code Section 9282, the City Council, or
any member or members of the City Council authorized by the City Council,
may file a written argument for or against a City measure; and
WHEREAS, pursuant to Election Code Section 9285, the author or a
majority of the authors of an argument relating to a city measure may prepare
and submit a rebuttal argument or may authorize in writing any other person or
persons to prepare, submit, or sign the rebuttal argument.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. That the City Council authorizes Vice Mayor Zack Scrivner,
Councilmember David Couch and Councilmember Ken Weir, members of the ~ 6AKF9

City Council, to file a written argument, not exceeding 300 words regarding the
City measure as specified above, accompanied by the printed names and
signatures of the authors submitting it, in accordance with Article 4, Chapter 3,
Division 9 of the Elections Code of the State of California, and to change the
argument until and including the date fixed by the City Clerk after which no
arguments for or against the City measure may be submitted to the City Clerk.
The argument shall be filed with the City Clerk, signed, with the printed
names and signatures of the authors submitting it, or if submitted on behalf of an
organization, the name of the organization, and the printed name and
signature of at least one of its principal officers who is the author of the
argument. The arguments shall be accompanied by the Form of Statement To
Be Filed By Authors of Argument.
2. The Kern County Taxpayers Association is hereby authorized to
prepare, submit and sign the rebuttal argument in favor of the City measure on
behalf of the Bakersfield City Council, not exceeding 250 words, accompanied
by no more than five printed names and signatures of the authors submitting it,
in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the
State of California by the date fixed by the City Clerk after which no rebuttal
argument may be submitted. The argument shall be accompanied by the Form
of Statement To Be Filed By Authors of Argument.
