RESOLUTION OF INTENTION NO. 1670
A RESOLUTION DECLARING INTENTION TO AMEND
THE MIRAMONTE DRIVE-CHASE AVENUE PLANNED
MAJOR THOROUGHFARE AREA AND PRELIMINARILY
APPROVING THE COST AND FEE SCHEDULE.
WHEREAS, Chapter 16.32.060.17 of Title 16 of the Bakersfield Municipal
Code and Section 66484 of the California Government Code, provides for a procedure by
which the City Council may assess and collect fees for the purpose of defraying the cost of
constructing bridge crossings or major thoroughfares identified in the transportation
circulation element of the Metropolitan Bakersfield 2010 General Plan, and;
WHEREAS, Miramonte Drive and Chase Avenue are designated as major
collectors for the Rio Bravo area, and;
WHEREAS, General Plan Amendment 05-1287, to amend the Circulation
Element of the Bakersfield General Plan and Chase Avenue Specific Plan Alignment , was
adopted per Resolution 041-06 of the City Council of the City of Bakersfield, and;
WHEREAS, construction of a portion of Miramonte Drive and Chase Avenue
will provide a much needed connection to Comanche Road and Highway 58 from the Rio
Bravo area, and;
WHEREAS, the owner of the property within Section 23, T.29 S., R.29 E.,
M.D.M., as a condition of approval of General Plan Amendment 04-0853, is required to
construct Miramonte Drive and Chase Avenue to Comanche Road through Sections 22
and 23, T.29 S., R.29 E., M.D.M. as part of the street improvements, and;
WHEREAS, other properties within the Rio Bravo area proposed to be
developed, or are now under construction and have been conditioned to participate in the
construction of Miramonte Drive and Chase Avenue as outlined above, and;
WHEREAS, the City Council formed the Miramonte Drive-Chase Avenue
Major Thoroughfare Area on June 20, 2007; and
WHEREAS, a portion of the improvements required to be constructed have
been completed by the County as a part of another project; and
WHEREAS, the cost estimate and fee per acre for the Major Thoroughfare
Area has been reduced commensurately; and
WHEREAS, the City has notified all affected property owners and is
modifying the Miramonte Drive-Chase Avenue Planned Major Thoroughfare Area to
reduce the cost of the improvements and reduce the fees required of subdivisions or

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The foregoing recitals are true and correct and are incorporated herein.
2. The Council hereby preliminarily approves the revised estimate,
attached hereto as Exhibit A, and the revised fee schedule attached hereto as Exhibit B for
the Miramonte Drive - Chase Avenue Planned Major Thoroughfare Area. Attached for
informational purposes are the original limits of improvements as shown on Exhibit C and
the original boundary of the area benefited by the construction as described on the map
attached hereto as Exhibit D, for the Miramonte Drive-Chase Avenue Planned Major
Thoroughfare Area. Subdivision or development of property within such Area will require
payment of fees per the attached schedule.
3. The City Council hereby fixes Wednesday, August 11, 2010, at 5:30
PM, or as soon as thereafter as may be heard, at the Council Chambers of the City
Council, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for hearing
protests on the following matters:

NOTICE OF PUBLIC HEARING BEFORE THE COUNCIL
OF THE CITY OF BAKERSFIELD
NOTICE IS HEREBY GIVEN that a public hearing accepting public testimony will be
held before the Council of the City of Bakersfield at 5:30 p.m., or as soon thereafter as
the matter may be heard, on Wednesday, August 11, 2010 in the Council Chambers of
City Hall, 1501 Truxtun Avenue, Bakersfield, California.
The hearing is to review the amendment of the Miramonte Drive-Chase Avenue
Planned Major Thoroughfare Area in the City of Bakersfield, County of Kern, State of
California in order to decrease the required fee for purposes of defraying the actual or
estimated cost of constructing the southerly extension of Miramonte Drive to Chase
Avenue and Chase Avenue between Miramonte Drive and Comanche Road. The
estimated cost of this improvement, fee schedule, map of improvements and map of the
benefited area are attached hereto as Exhibits "A", "B", "C" and "D", respectively. The
cost of the improvement has been apportioned on an equal per acreage basis.
All persons interested shall be given an opportunity to appear and be heard at the
hearing. Written comments will be accepted on or before the hearing date indicated
above at the City Clerk's Office, 1501 Truxtun Avenue, Bakersfield, CA 93301. Said
hearing may be continued from time to time as may be determined by the Council.
Property owners not in possession of affected properties shall notify occupants of this
proposed project.
Any person challenging in court the decision made at the conclusion of such public
hearing may be limited to raising only those issues raised at such hearing or in
correspondence delivered to the City of Bakersfield prior to the close of such hearing. If
