A RESOLUTION DETERMINING THAT SOLARBEE
SOLAR-POWERED WATER CIRCULATION EQUIPMENT
FOR A RECHARGE POND CANNOT BE REASONABLY
OBTAINED THROUGH THE USUAL BIDDING
PROCEDURES AND AUTHORIZING THE FINANCE
DIRECTOR TO DISPENSE WITH BIDDING NOT TO
EXCEED THE BUDGETED AMOUNT OF $45,000.
WHEREAS, the City owns several recharge ponds that are part of its domestic
water distribution system; and
WHEREAS, the City does regular maintenance on its recharge ponds to increase
water quality and reduce invasive aquatic weed and algae growth with minimum
chemical applications; and
WHEREAS, solar powered reservoir circulator devices is a proprietary product,
distributed through SolarBee, Inc. and is therefore a sole source product; and
WHEREAS, the Finance Director has determined and has recommended the
Council find, that the purchase of a solar powered reservoir circulator device can only
be reasonably obtained from one vendor, SolarBee, Inc., because of exclusive
representation restricted by the manufacturer and has recommended that this Council
authorize dispensing with bidding requirements in accordance with subsection D.1 of
Section 3.20.060 of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The above recitals are true and correct and incorporated herein by
reference;
2. The City Council hereby finds that the purchase of SolarBee water
circulation equipment for City owned recharge ponds can only be reasonably obtained
from one vendor SolarBee, Inc, for the reasons set forth above.

3. The Finance Director is authorized to dispense with bidding therefore in
accordance with Section 3.20.60 of the Bakersfield Municipal Code and to negotiate the
purchase of same on a one time basis, not to exceed budgeted amount of $45,000.
