PUBLIC STATEMENTS None DEFFERED BUSINESS AGENDA SUMMARY REPORT Planning and Development Committee Thursday, September 9,201 0 Page 2 A. Update Regarding the Status of the Habitat Conservation
Plan and the New Permit Process -Eggert City Planning Director Eggert reported that the California Department of Fish and Wildlife, with the assistance of City staff, was unsuccessful
in receiving a federal grant of $825,146, which would have helped to fund the initial research and data compilation towards preparation of a new Habitat Conservation Plan (HCP). Staff
will apply for the grant again when the application period opens, which is anticipated to be in September or October, with the results available in May or June of 201 1. A task force,
created by the development community, is currently exploring available public and private funding sources. Donna Carpenter with Sikand Engineering provided a brief description of two
meetings the task force participated in with Eric Tattershall, Chief of the Conservation Planning Branch of the U.S. Fish and Wildlife Service (USFWS), and John McKamman, Director of
the California Department of Fish and Game (CDFG) to discuss possible solutions for a gap agreement and/or the extension of the existing agreement. Committee member Hanson asked how
the development community would be affected if the HCP is not extended. City Manager Tandy stated the effects will vary, depending on if there are species present on the property to
be developed. Individual agreements, with both USFWS and CDFG, would need to be negotiated, which could take some time. Ms. Carpenter stated that support letters are being requested
from various elected officials and community organizations. All the letters will be given to Assemblywoman Jean Fuller, who will deliver them to John McKamman of CDFG. Committee Chair
Scrivner made a motion for staff to prepare and forward to the full Council a resolution supporting preparation of a new Metropolitan Bakersfield Habitat Conservation Plan and a time
extension of the current plan's existing permits with the USFWS and CDFG. The motion was unanimously approved. COMMITTEE COMMENTS None ADJOURNMENT The meeting adjourned at 1 :20 PM S:\Council
