RELEASE October 4, 2010 On 10/3/10, at 12:04 a.m., the Bakersfield Police Department received a 911 call from a 47 year old woman who reported she had been physically and sexually assaulted
by her boyfriend, Fabian Rodriguez Garcia aka Roberto Fabian Rodriguez 23. The woman called from the pay phone at 509 Chester Avenue and reported the assault took place at Garcia’s apartment
at 500 H Street #B. The victim reported that she was at Garcia’s apartment consensually initially but when she refused to have intercourse, Garcia sexually assaulted her and refused
to let her leave for approximately two hours. The victim eventually armed herself with an ink pen and stabbed Garcia with it multiple times to facilitate her escape. She ran directly
to the pay phone to report the assault. She also informed officers that Garcia had access to a handgun. Officers surrounded the apartment and patrol officers made contact at the front
door. Sergeant Graydon Argast took up a position on the south side of the apartments’ exterior. A relative answered the front door to the apartment and informed officers that Garcia
was in the south east bedroom of the apartment. As officers made entry into the apartment, Garcia started exiting the bedroom window on the south side of the residence. As Garcia was
exiting through the window Sergeant Argast illuminated Garcia with his flashlight and Garcia, who was armed with a handgun, pointed the weapon in Sergeant Argast’s direction, at which
time, Sergeant Argast fired at him one time, striking the window screen but missing Garcia. Garcia dropped the handgun and retreated inside where he was taken into custody by the patrol
officers after a brief struggle. Garcia was arrested for attempted rape, forcible digital penetration, spousal abuse, false imprisonment, assault on a peace officer and resisting arrest.
Sergeant Argast has been place on routine administrative leave. A Critical Incident Investigation per department policy is being conducted.
