ROLL CALL Present: 2. 3. Agency Members Pickett, Koman, Knapp, Ordiz, Prince, Bentley(4:03 pm) PUBLIC STATEMENTS Marvin Dean submitted a letter signed by Mayor Hall in 2001 to staff and the Agency Members. He requested consideration of a change in the language of the development agreements to include language addressing at least 10% of the workforce be obtained from the workers in the project areas. He asked that consent calendar item 3.f. be removed so the public can have more information on that project. CONSENT CALENDAR a. Minutes of the July 12, 2010 regular meeting. b. Approval of department payments from June 30, 2010 to August 5, 2010 in the amount of $1,712,133.01. C. Amendment No. 2 to Agreement No. RA08-015 with Chelsea Investment Corporation to authorize Agency to construct street improvements on private streets consisting of 14th Street north, 13th Street and a portion of "R" Street for South Mill Creek Affordable Apartment development, require developer to participate in a landscape maintenance district, and be responsible for payment of maintenance, irrigation and electricity costs. d. Amendment No. 3 to Agreement No. RA09-001 with Creekview Villas, LLC, to authorize Agency to construct street improvements on private streets consisting of 14th Street south, 13th Street and a portion of "R" Street within the Creekview Villas development, require developer to participate in a landscape maintenance district and be responsible for payment of maintenance, irrigation and electricity costs. Amendment No. 2 to Agreement No. RA09-004 with Mill Creek Courtyard, LLC to authorize Agency to construct street improvements on private streets consisting of 14th Street south, 13th Street and a portion of "R" Street for the Mill Creek Courtyard development, require developer to participate in a landscape maintenance district and be responsible for payment of maintenance, irrigation and electricity costs. RA09-004(2) f. Assignment Agreement for use of Home Funds for the 19th Street Senior Plaza Project with the Bakersfield REMOVED FOR Redevelopment Agency for use of federal HOME SEPARATE DISCUSSION Investment Partnership Funds ($1,300,000) for a housing project located at 519 19Th Street. Motion by Koman, seconded by Prince, to approve Consent Calendar items 3.a. thru 3.e. with the removal of item 31 for separate discussion. f. Assignment Agreement for use of Home Funds for the 19th Street Senior Plaza Project with the Bakersfield Redevelopment Agency for use of federal HOME Investment Partnership Funds ($1,300,000) for a housing project located at 519 19th Street. Motion by Prince, seconded by Knapp, to approve Consent Calendar item 31 4. PUBLIC HEARINGS None 5. REPORTS a. Update status of Baker Street Mixed Use Project. b. Update status of Mill Creek Project. ED/CD Director Donna Kunz gave staff report on both Projects. City Manager Alan Tandy provided additional comments. 6. DEFERRED BUSINESS APPROVED RA 10-008 AGR 10-096 APPROVED None 348 Bakersfield, California, August 18, 2010- Page 3 7. NEW BUSINESS ACTION TAKEN a. Agreement between the Bakersfield Redevelopment RA10-009 Agency and the 19th Street and "I" Investment Group, LLC for $612,000 housing set-aside funds for the construction and development of a nine(9) unit rental housing project at 1612 19th Street. Staff report given by ED/CD Director Donna Kunz. In response to Agency Member Ordiz's question, it was confirmed that work would be 100% local, with the exception of the architect who is out of the area. For the record Agency Member Prince indicated he would abstain from the vote due to the relationship with the contractor. Chairperson Bentley indicated he would abstain from the vote due to the relationship with the contractor. Motion by Ordiz, seconded by Pickett, to approve APPROVED Agreement with Member Prince and Chairperson Bentley ABS PRINCE, BENTLEY Abstaining. b. Amendment No. 2 to Agreement No. RA08-014 with RA08-014(2) 19th Street Senior Plaza, LLC (in an amount not to exceed $3,200,000) for the construction and development of 67 units of senior rental housing and a parking garage. 1. Authorize the loan of $1,300,000 in federal HOME Investment Partnership Funds for the Development of eleven(11) affordable Housing units at the 19th Street Senior Plaza Project located at 519 19th Street; and 2. Authorize a grant of $1,900,000 necessary to partially fund the cost of engineering, design and construction of the parking garage located at 511 19th Street. Presentation report given by ED/CD Director Donna Kunz. City Manager Tandy provided additional comments. Motion by Koman, seconded by Prince, to approve APPROVED amendment. l 349. 8. Bakersfield, California, August 18, 2010- Page 4 C. South Mill Creek Easement Purchase; l . Loan Reimbursement Agreement with The City of Bakersfield for $950,000 for the Purchase of a City owned 1.95 acre Easement located to the east of P/Q Streets and south of the B.N.S.F. railroad a tracks for the South Mill Creek Project. Staff report given by ED/CD Director Donna Kunz. City Manager Tandy provided additional comments. Finance Director Nelson Smith responded to Agency Member Koman's questions. Motion by Knapp, seconded by Pickett, to approve agreement. AGENCY STATEMENTS Agency Member Prince inquired about status of the response to Mr. Dean's comments that the agency look into changing the language regarding participation of those in the southeast community project areas. ED/CD Director Kunz responded that she would give a written report to the members at the next meeting. Agency Member Koman, in regards to the same topic as above, stated it is an interest to the agency not only in the southeast project area but to the City of Bakersfield and the local area. ED/CD Director Donna Kunz responded that a concerted effort has been given to Mr. Dean's Contractors Association by distributing plans and letting him know when bids are being solicited. ED/CD Director Kunz stated the developers have showed an expressed willingness to pass on information and invite Mr. Dean to meetings. Assistant ED/CD Director Rhonda Barnhard added that a prior project far exceeded there local hiring obligation. Chairperson Bentley stated that locals are being hired for the jobs the project or development creates. Some benefits do come after the completion of the development. KCSC Case No. S-1500-CV-265174 SPC. Motion by Ordiz, seconded by Pickett to adjourn to Closed Session at 5:10 p.m. Motion by Bentley to adjourn from Closed Session at 5.24 p.m. CLOSED SESSION a.
