Home My WebLink AboutRES NO 137-10RESOLUTION NO. 137-10 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ACCEPTING CITY CLERK'S CERTIFICATION DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF THE CITY A MEASURE RELATING TO PENSION BENEFITS, MEASURE "D," HELD ON THE 2ND DAY OF NOVEMBER 2010. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Bakersfield does hereby find, determine and declare as follows: SECTION 1. A. That pursuant to applicable law, a General Municipal Election was held and conducted in the City of Bakersfield on the 2nd day of November 2010; and B. That said election was held and conducted in conformity with all applicable provisions of law; and C. That said election was held for the purpose of submitting to the electors of the City of Bakersfield the following measure: MEASURE "D" YES Shall the City of Bakersfield adopt the following law: Effective January 1, 2011, new City of Bakersfield sworn public safety employees will pay 100% of their employee pension NO contribution and be eligible for a maximum retirement allowance with the Board of Administration of the Public Employees' Retirement System (PERS) at a 2% at age 50 Formula based on their average salary calculated over 36 highest paid consecutive months. D. That pursuant to the direction of the City Council, the County Clerk of the County of Kern has conducted a Canvass of Results, attached hereto as Exhibit "B," which has been examined and accepted by the City Clerk; and 1 r rJ E. That the City Council does hereby accept the City Clerk's Certification of the Canvass of Results, attached hereto as Exhibit ' A," and does hereby resolve, determine and declare the results of the General Municipal Election for Measure "D," to be as follows: YES Measure "D" 40,305 NO 32,693 F. That the City Council does declare and determine Measure "D" passed by the electors of the City of Bakersfield, and is effective December 25, 2010; and G.
