Hearing closed. Commissioner Tkac moved, seconded APPROVED by Commissioner Haddock to approve Consent Calendar Non-Public Hearing MCGINNIS Items 1, 2 and 3. Public hearing closed PC Minutes June 17, .:1010 Page 3 Mary Jane Wilson answered Commissioner Tkac's question regarding how 0 net energy is obtained and if there is a pollution component in the process. Commissioner Tragish moved, seconded . RES NO by Commissioner Tkac to adopt a 19-10 Resolution (Exhibit A), making CEQA findings (Sections 15091 and 15093 of the MCGINNIS State CEQA Guidelines), approving ABSENT mitigation measures, adopting a Statement of Overriding Considerations, a mitigation monitoring program, and recommending certification of the Final EIR for GPA/ZC No. 06-2247 to the City Council including two City of Bakersfield memorandums from Marian Shaw dated June 15, 2010 and June 17, 2010. Commissioner Tragish moved, seconded RES NO by Commissioner Tkac to adopt a 20-10 Resolution (Exhibit B), making findings and approving the requested General MCGINNIS Plan Amendment to change the Land ABSENT Use Designations as depicted in Exhibit B-2, with conditions of approval, adopting a Statement of Overriding Considerations and mitigation monitoring program, and recommend the same to the City Council including two City of Bakersfield memorandums from Marian Shaw dated June 15, 2010 and June 17, 2010. Commissioner Tragish moved, seconded RES NO by Commissioner Haddock to adopt a 21-10 resolution (Exhibit C), making findings and approving the requested Zone MCGINNIS Change as depicted in the attached ' ABSENT Exhibit C-2 and further described in Exhibit C-6, with conditions of approval, adopting a Statement of Overriding Considerations and mitigations monitoring program, and recommend the same to City Council including two City of Bakersfield memorandums from Marian Shaw dated June 15, 2010 and June 17, 2010. PC Minutes June 17, 2010 Page 4 Commissioner Tragish moved, seconded RES NO by Commissioner Strong to adopt a 22-10 resolution (Exhibit D), making findings and approving the preliminary development 1 MCGINNIS plan (PD No. 09-0162) for the ABSENT development of a new commercial development on approximately 65 acres, with conditions of approval, adopting a Statement of Overriding Considerations and mitigation monitoring program, and recommend the same to the City Council including two City of Bakersfield memorandums from Marian Shaw dated June 15, 2010 and June 17, 2010. Commissioner Tragish moved, seconded RES NO by Commissioner Tkac to adopt a ` 23-10 resolution (Exhibit E), making findings and approving the preliminary development MCGINNIS plan (PD No. 09-0163) for the ABSENT development of a new commercial development on approximately 79 acres, with conditions of approval, adopting a Statement of Overriding Considerations and mitigation monitoring program, and recommend the same to City Council including two City of Bakersfield memorandums from Marian Shaw dated June 15, 2010 and June 17, 2010. G. COMMUNICATIONS Mr. Eggert stated that because the City Council has not approved the budget he is unable to update the Commission as previously stated and will defer the update to the July 1St meeting, H. COMMISSION COMMENTS Commissioner Tkac stated concerns about global warming and making decisions on something that has not been proven scientifically to be true or untrue. Mr, Eggert responded that decisions are made according to State CEQA law, which requires analysis of greenhouse gases. Therefore, a project, if challenged, can legally be defended.
