RESOLUTION OF THE CITY OF BAKERSFIELD REGARDING
THE USE OF HOUSING SET-ASIDE MONIES (CREEKVIEW
VILLAS DOWN PAYMENT ASSISTANCE PROGRAM,
SOUTHEAST BAKERSFIELD REDEVELOPMENT PROJECT
AREA) OUTSIDE THE DOWNTOWN REDEVELOPMENT
PROJECT AREA.
WHEREAS, there is a need in the City of Bakersfield (the "City") for decent, safe
and sanitary housing and particularly for housing affordable to low-income and
moderate-income persons; and
WHEREAS, the Community Redevelopment Law of the State of California
(Health and Safety Code Section 33000 et.seq.), (the "Law"), imposes specific
obligations on each redevelopment agency to respond to housing needs within their
jurisdiction, including, but not limited to, establishment of a Low-and Moderate-
Income Housing Fund (the "Fund"), and
WHEREAS, Section 33334.2 of the Law provides that the redevelopment agency
shall use not less than twenty percent (20%) of all taxes which are allocated to it for
the purposes of increasing, improving, and preserving the community's supply of low-
and moderate-income housing; and
WHEREAS, Section 33334.2 also provides that an agency may use these funds
inside or outside the Redevelopment Project Area upon a resolution of the agency
and the legislative body that such use of funds will be of benefit to the
Redevelopment Project Area; and
WHEREAS, land uses in the Downtown Bakersfield Redevelopment Project Area
are not conducive to the construction of single-family units; and
WHEREAS, there has been virtually no growth in conventional housing in the
Redevelopment Project Area and the existing housing inventory is almost exclusively
occupied by low-income households; and
WHEREAS, a number of conditions limit the ability of the Bakersfield
Redevelopment Agency (Agency) to provide residential development in the
Redevelopment Project Area, such as, the existing land uses and socio-economic
characteristics of the Redevelopment Project Area and the relatively limited funds

available from the Agency's Low-and Moderate-Income Housing Fund compared to
the cost of downtown housing development; and
WHEREAS, with plentiful land and an active residential development market,
outside of the Redevelopment Project Area, but within the limits of the City of
Bakersfield, Bakersfield offers some of the most affordable housing of any major
metropolitan area in the state of California; and
WHEREAS, the Agency can provide more people affordable housing
opportunities by allowing the use of housing monies outside the Downtown
Redevelopment Project Area; and
WHEREAS, the Agency has provided assistance in acquisition of land for the
construction of affordable single family units located at 1203 "R" Street known as the
Creekview Villas; and
WHEREAS, the Agency desires to continue to create and promote home
ownership and improved affordable housing for individuals and families; and
WHEREAS, the Agency desires to provide down payment assistance for eligible
low- or moderate-income persons or families purchasing a Creekview Villa home to
assist in ensuring the affordability of the units; and
WHEREAS, affordable housing continues to be a priority of the Agency in its
adopted Five-Year Implementation Plans; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD as follows;
1. The above recitals are true and correct,
2. The use of funds from the Low- and Moderate-Income Housing Fund
outside of the Redevelopment Project Area will benefit the
Redevelopment Project Area.
3. The Agency shall use up to $465,000 from the Agency's Downtown Low-
and Moderate-Income Housing Fund to be used to fund a portion of the
down payment assistance for the Creekview Villas.
4. The use of low-moderate-income housing funds to provide affordable
housing is consistent with the Five-Year Implementation Plan,

the Council of the City of Bakersfield at a regular meeting thereof held on
