ROLL CALL ACTION TAKEN Present: Mayor Price, Councilmembers DeMond, Carson, Smith (seated at 5:25), McDermott, Rowles (seated at 5:30), Sullivan (seated at 5:20), Salvaggio Absent: None 2. DOWNTOWN STREETSCAPE. Economic Development Director Wager provided information on design standards and distributed bound material entitled, "Chester Avenue Streetscape Master Plan - Downtown City of Bakersfield"; and requested Council support for a Resolution being placed on the October 11, 1995 Agenda. Motion by McDermott to add Closed Session APPROVED Item 1. that arose after the Agenda was posted and requires action this evening. 3. WARD REAPPORTIONMENT. City Manager Tandy requested Council instruction to move forward. Development Services Director Hardisty presented the latest changes requested by Council and asked for other alternative requests. Motion by McDermott leave the areas NAT north of Wilson Road (Precincts 457, 455 and 408) in Ward 6; place the area between White Lane and Planz Road (Precincts 228W and 213) in Ward 7; and place Precinct 450 from Ward 7 to Ward 6 and use these changes as the "baseline". Amended motion by Rowles to move NAT Precincts 351 and 403 back in Ward 5. Motion by McDermott leave the areas APPROVED north of Wilson Road (Precincts 457, 455 and 408) in Ward 6; place the area between White Lane and Planz Road (Precincts 228 and 213) in Ward 7; place Precinct 450 from Ward 7 to Ward 6; place Precincts 351 and 403 back in Ward 5; and use these changes as the "baseline mapm. Motion by DeMond to place the mbaseline APPROVED mapm on the September 27, 1995 agenda NS ROWLES for action. CLOSED SESSION ACTION Mayor Price announced Closed Session action as reflected on Page 1. 5. PRESENTATIONS a. Presentation by Mike DeMario, Division Manager, P.G.& E., presented a corporate donation of $10,000 for the Bakersfield Envirotech Incubator. b. Presentation by Mayor Price of proclamation to Bakersfield Fire Chief Mike Kelly, proclaiming September 18 - 24, 1995 as "Pollution Prevention Week". 6. PUBLIC STATEMENTS a. The following individuals spoke regarding the proposed stadium: Stuart Gentry and Pam Binns. Salvaggio requested a copy of Ms. Binns statement. 7. APPOINTMENTS a. One (1) appointment to the Central District Development Agency due to the resignation of Phillip Gaskill, term expiring April 22, 1999. Mayor Price nominated Evelyn M. Jenkins. Payments from August 11 to August 24, 1995 in the amount of $4,765,578.05; and Self Insurance payments from August 11 to August 24, 1995 in the amount of $310,415.14. b. Minutes of the Workshop, Closed Session and Regular Meeting of August 30, 1995. C. Resolution approving the destruction of certain obsolete City records, documents, instruments, books and papers, pursuant to Government Code Section 34090 et seq. (Public Works Department - Street Maintenance). d. Resolution determining that Firearms Retention Systems (holsters and magazine pouches) for the Bakersfield Police Department cannot be reasonably obtained through the usual bidding procedure and authorizing the Finance Director to dispense with bidding therefor, not to exceed $42,000. e. Accept bid from Jim Burke Ford ($1,157,194.31) for 55 police sedans. n. Reject all bids for Panama No. 10 Annexation Nadeau Area Sewer. (Ward 7) (Staff recommends reject all bids and direct staff to reevaluate project for future bidding to ensure that bidders comply with the funding requirements and to come closer in line with the approved budget of $369,750) Motion by DeMond to adopt Items (a) APPROVED through (n) of the Consent Calendar, with the exception of items k. and 1. Amendment No. 1 to Consultant Agreement No. 94-185 with Renfro & Associates for design of addition to Bakersfield Police Station. (Ward 2) Motion by Saivaggio to adopt item k. of the Consent Calendar. 1. Accept bid from Inacom Information Systems ($260,144.71) to replace 134 personal computers and monitors. Motion by DeMond to reject all bids for Item 1. of the Consent Calendar. HEARINGS a. Bearing as required to hear public testimony for Assessment District No. 94-3, Silver Creek/Brimhall North/Seven Oaks/South Laurelglen. (Ward 4) Mayor Price announced this is the first of two hearings to be held on this issue, with no action required tonight. A protest hearing will be held September 27, 1995. Hearing opened at 7:20 p.m. No one spoke at hearing. Hearing closed at 7:20 p.m. b Continued hearing for General Plan Amendment 2-95 (formerly GPA 4-94), Segment VIII (Ward 3): 1. City of Bakersfield requests to amend the Metropolitan Bakersfield 2010 General Plan Circulation Element, adopting specific plan lines for Morning Drive, Paladino Drive and an "unnamed" collector. (Continued from 8/30/95) Development Services Director Hardisty provided background information. Hearing closed at 7:22 p.m. Motion by Smith to adopt Resolution. 10. REPORTS a. Legislative and Litigation Committee Report No. 1-95 regarding Gas-Powered Leaf Blowers. Motion by Rowles to accept Report. b. City Manager Oral Report No. 13-95 regarding status of the Stadium/Sports Complex. City Manager Tandy provided information on options regarding a proposed stadium, presented a slide presentation, distri- buted written material; and requested Council achieve a decision whether to pursue this project. 11. DEFERRED BUSINESS a. Ordinance amending Title 17 of the Bakersfield Municipal Code and Zoning Map No. 123-07 by changing the zoning from Limited Multiple Family Dwelling to One Family Dwelling on 7.47 acres; and from Limited Multiple Family Dwelling to one Family Dwelling on 9.28 acres, located between Old River Road, Ming Avenue, White Lane and Buena Vista Road. Ordinance amending Title 17 of the Bakersfield Municipal Code and Zoning Map No. 104-16 by changing the zoning from County Estate Residential- Residential Suburban Combining, Low Density Residential and Neighborhood Commercial-Precise Development Combining to City of Bakersfield Residential Suburban, One Family Dwelling and Neighborhood Commercial on 53 acres, located southwesterly and southeasterly of the intersection of State Route 178 and Comanche Drive. Ordinance amending Title 17 of the Bakersfield Municipal Code and Zoning Map No. 102-31 by changing the zoning from Agriculture, 20 acre minimum lot size, to Planned Unit Development on 20.30 acres, located between the proposed Kern River Freeway, Cross Valley Canal and the adopted Calloway Drive alignment. Ordinance amending Title 17 of the Bakersfield Municipal Code and Zoning Map No. 123-06 by changing the zoning from Limited Multiple Family Dwelling to One Family Dwelling on 12 acres, located between Old River Road, Ming Avenue, Buena Vista Road and Kern River Canal. Martin McIntosh, representing castle a Cooke Homes, Inc., requests to amend the Metropolitan Bakersfield 2010 General Plan Circulation Element by eliminating the collector alignment along Camino Media from Old River Road westerly to the terminus of Grand Lakes Avenue for property located between the Kern River Canal, Old River Road, Ming Avenue and Buena Vista Road. Ordinance amending section 13.08.060 of FR the Bakersfield Municipal Code relating to notice to buyers of special assessment district liens. City Attorney Skousen provided back- ground information. DeMond requested City Attorney Skousen provide copies of the notice to Council. b. Memorandum of Understanding with County AGR 95-244 of Kern agreeing to a Master Tax Split and cooperating on service duplication issues. City Manager Tandy provided background information. Motion by McDermott to approve Agree- APPROVED ment. NS SALVAGGIO 13. COUNCIL STATEMENTS Salvaggio requested Public Works move rapidly on the sewer for Panama No. 10 Annexation. Salvaggio requested Police Chief Brummer follow up on the request to Lt. Darby regarding traffic problems at Claire and O'Neill. Salvaggio thanked Lt. Darby for his help along Pacheco Road regarding illegal parking of commercial vehicles. Bakersfield, California, September 13, 1995 - Page 10 13. COUNCIL STATEMENTS continued Salvaggio requested street resurfacing at the intersection of E1 Caballo Road and Mesa Grande. Smith requested Police Chief Brummer monitor speeding on Christmas Tree Lane near the High School. Smith requested the shopping area on the east side of Bakersfield College be patrolled for graffiti. Smith requested the City Attorney office examine City dust regulations for the dust or dirt removal problem at Fairfax near the Royal Coach Estates. McDermott requested his referral regarding fire access at Quailwood be responded to. McDermott stated his concern on the traffic situation at Calloway and Hageman. DeMond requested radar on Monterey Street residential area. DeMond requested Economic Development Director look into working with Bakersfield College on the graffiti problem at the shopping center on the east side of the college. DeMond stated concerns of abandoned properties and buildings. Rowles directed staff to notice the October 25th Council Meeting as commencing at 5:15 p.m. instead of 7:00 p.m. Rowles alluded to correspondence received from the property management company responsible for Kern City requesting the alley behind Sunny Palms Avenue be paved. COUNCIL STATEMENTS continued ACTION TAKEN Rowles announced Legislative & Litigation Committee has scheduled a series of special meetings for the purpose of incorporating Council comments on the League of California Cities resolutions. Rowles requested Public Works provide an update (one-page synopsis) on the drainage study on Westwood Estates. Rowles requested an update on the Convention Center HVAC. Rowles mentioned the Chester Avenue Street- scape and concerns regarding the signs and banners regulations governed by city ordinance. Rowles commented on the baseball proposal and the response and lack of support from County of Kern. 14.
