HomeMy WebLinkAbout2011_05_10_OIS Update BAKERSFIELD POLICE DEPARTMENT PRESS RELEASE Greg Williamson, Chief of Police Contact: Sergeant Mary DeGeare Public Information Officer 661-326-3803 mdegeare@Bakersfieldpd.us For Immediate Release May 9, 2011 On 5/9/11, officers were dispatched to 6513 Peggy Way regarding a trespass and peace disturbance involving a resident who was evicted earlier in the day by the bank and the Sheriff’s Department Civil Division. At that time, the residence was secured by a contractor, who is employed by the bank. At 3:21 p.m., the contractor called the police department and reported the resident and another person returned and forced entry and the resident was refusing to leave. The contractor opted to leave until officers were available to respond to the reported trespass. Officers Chad Haskins and John Buoni were dispatched at 7:26 p.m. When the officers made contact at the residence there was no answer and the front and rear doors were locked. The officers moved away from the house to telephone the contractor who was waiting to be contacted by phone to return when officers arrived. While waiting for his return, the officers observed someone inside open and close the front door to the residence and they returned to make contact. The officers knocked and announced their presence and eventually the resident, Adrian Perez 26, opened the front door. The officers ordered Perez to exit and he refused. Perez repeatedly reached into his pant pocket despite orders to keep his hands where the officers could see them, stating, “Why don’t you just kill me”. Officer Buoni drew his duty gun and ordered Perez to remove his hand from his pocket and Perez complied. Officer Buoni holstered his weapon and both officers moved in to arrest Perez; however, Perez began putting his hand in the same pocket again, at which time, Officer Buoni drew his baton and struck Perez on the arm to prevent him from doing so. Perez backed into the home through the front door, removed a handgun from the same pocket and fired at the officers, who both drew their weapons and returned fire while backing away to obtain cover. Officer Haskins ran into the back yard to set up a perimeter to prevent Perez’ escape. Minutes later Perez exited the rear door and fired again at Officer Haskins who returned fire. While Officer Buoni maintained a perimeter in the front yard, Officers Shane Shaff and Joseph Arms entered the back yard to assist Officer Haskins, at which point Perez appeared in the rear door again with gun in hand and all three officers fired striking Perez who then fell to his knees and dropped the gun but continued to move forward in an attempt to pick it up. Officers fired again and Perez desisted. Once officers handcuffed Perez, he was immediately taken by assisting officers to a neighboring front yard where it was safer for medical personnel to administer aide while officers searched the house for the reported second trespass suspect. Officers searched the residence and no one else was inside. Perez was pronounced dead at the scene. During the investigation, it was discovered that Perez was responsible for an armed robbery on 5/4/11, at the Fastrip at Panama Lane and South H Street in which a handgun was used. Investigators believe Perez may have thought the officers were contacting him for that reason rather than for trespassing. The surveillance photo is attached.
