Legislative and Litigation Committee Agenda Summary Report November 15,2010 Page2 3. PUBLIC STATEMENTS Liz Keogh, a volunteer for animal control, reported that she has one possible solution
to pet overpopulation. The County enacted an ordinance that became effective February 2, 2010 that provides for 10% of the licensing fees for dogs to go into a spay/neuter fund as a
means of funding spaylneuter programs and low cost clinics. Ms. Keogh asked the Committee to lobby their colleagues on the City Council to implement a similar ordinance. Committee Chair
Benham indicated that if a Committee member is interested in pursuing this, the matter would be referred to staff and subsequently included on an upcoming Committee agenda. Committee
member Sullivan stated that she is very interested in pursuing this issue. The matter will be referred to staff. 4. DEFERRED BUSINESS a. Update regarding Alarm Permits and Collection
of Fees -Williamson /Bianco Police Captain Bianco reported that the Bakersfield Police Department responds to many alarms, 97% of which are false alarms. At the direction of the Committee,
staff met with the alarm companies to explain the proposed changes and to get their input. Outsourcing collection of the fees is being researched. Staff is also reviewing changes to
the Municipal Code to bring better accountability to the alarm installation and monitoring companies. A follow up meeting with the alarm companies will be held, and staff will report
back to the Committee. b. Update regarding Retail Permits for Tobacco -TegliaIRudnick. Assistant to the City Manager Teglia reported that if a revised ordinance is adopted, there will
be a new fee of $1 65.00 per retailer. The fee is to encourage responsible tobacco retailing, and discourage violations of laws. Staff met with the County on several occasions, and if
the City was to adopt the ordinance, the County has indicated that their staff would be in a position to fully administer the program. The passage of Proposition 26 may affect this issue,
so staff will seek an opinion from County Counsel and the Attorney General's Office to determine if this is considered a new fee or new tax, and what process may be necessary should
this be considered a tax. 5. NEW BUSINESS None 6. CLOSED SESSION None 7. COMMITTEE COMMENTS None 8. ADJOURNMENT The meeting adjourned at 1 1 :56 a.m.
