A RESOLUTION DECLARING INTENTION TO
ESTABLISH THE SEWER PLAN FOR THE
HOOPER AVE. & KIMERBLY AVE. PLANNED
SEWER AREA AND PRELIMINARILY
APPROVING THE COST AND FEE SCHEDULE
AND THE BOUNDARIES OF THE AREA.
RECITALS
WHEREAS, Chapter 16.32.060.E of Title 16 of the Bakersfield Municipal
Code and Section 66483 of the California Government Code, provides for a
procedure by which the City Council may assess and collect fees for the
purpose of defraying the cost of constructing sewer facilities for local and
neighborhood sewer areas, and;
WHEREAS, The City of Bakersfield desires to provide sewer facilities
for two areas annexed to the City on December 17, 2008 and June 28, 2009 as
shown on the map entitled "Hooper Ave. & Kimberly Ave. Planned Sewer Area"
attached hereto as Exhibit "B", and incorporated by reference, and;
WHEREAS, the City has constructed the sanitary sewer line as shown
on Exhibit "B", and;
WHEREAS, the City plans to construct or have constructed the
remaining lines as shown on Exhibit "B", and
WHEREAS, the City desires to recoup the cost of constructing said
sewer line, and;
WHEREAS, the fees and charges set forth in Exhibits "A" attached
hereto and incorporated by reference, are based on the actual cost of
providing the services for which the fees are charged.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1, The foregoing recitals are true and correct and are incorporated
herein.

2. The Council hereby preliminarily approves the cost and fee
schedule attached hereto as Exhibits "A", and the boundary of the "Hooper
Ave. & Kimberly Ave. Planned Sewer Area" area of benefit and limits of
improvements as described on the map attached hereto as Exhibit "B".
Subdivision or development of property within such area will require payment of
fees per the attached schedule.
3. The City Council hereby fixes Wednesday, July 13, 2011, at 5:15 PM, or as
soon as thereafter as may be heard, at the Council Chambers of the City
Council, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for
hearing protests on the following matters:

HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof
