RESOLUTION OF THE CITY OF BAKERSFIELD AUTHORIZING THE
RECORDING OF A HOUSING COVENANT ON CITY OWNED
PROPERTY LOCATED AT 408 AND 424 20TH STREET AS REQUIRED
FOR THE STATE OF CALIFORNIA PROP IC GRANT FOR MILL
CREEK.
WHEREAS, on December 18, 2008 the City Council approved the purchase of
vacant property located at 408 and 424 20th street for the purpose of eliminating
blight within the Millcreek Linear Park area; and
WHEREAS, the property was purchased using Community Development Block
Grant funds and will be used for an affordable housing project to be constructed on
site; and
WHEREAS, on March 31, 2009 the Bakersfield Redevelopment Agency
authorized staff to apply for and receive a State of California, Department of Housing
and Community Development (Department) Infill Infrastructure Program grant in the
amount of $10,847,200 for the Southeast Bakersfield and Old Town Kern
Redevelopment Project Areas; and
WHEREAS, a statutory requirement of the grant is to place covenants on the
five (5) housing projects in the Millcreek area to ensure affordability of the housing
projects for 45 to 55 years; and
WHEREAS, California Community Redevelopment Law requires covenants on
housing projects to ensure affordability of the housing projects for 45 to 55 years; and
WHEREAS, the Bakersfield Redevelopment Agency is requesting approval of
the City Council to record the affordability covenant on the property located at 408
and 424 20th street; and
NOW, THEREFORE, BE IT RESOLVED by the City of Bakersfield of the City of
Bakersfield as follows;
SECTION 1. The City of Bakersfield authorizes the City Manager or his designee
to execute any and all documents required by the State for the property located at
408 and 424 20th street and make minor revisions if necessary.

SECTION 2. This Resolution shall be effective immediately upon its adoption,

HEREBY CERTIFY that the foregoing Resolution was passed and adopted by
the City Council of the City of Bakersfield at a regular meeting thereof held on
