HomeMy WebLinkAboutRES NO 060-11RESOLUTION NO. 0 6 0- 11 A RESOLUTION DECLARING REAL PROPERTY SURPLUS TO THE NEEDS OF THE CITY AND AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE ITS SALE WHEREAS, the City owns a fee simple interest in property located west of Canteria Drive and north of State Highway 178; and, WHEREAS, Juliana's Garden, LLC, a California limited liability company has requested the City sell this property depicted in Exhibit "A" in red attached hereto to facilitate the conveyance of all landscaping areas to the Julia Garden's Homeowners Association who will be responsible for their maintenance. WHEREAS, the Bakersfield Planning Department found the sale of this property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to Government Code Section 65402. WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale of City property deemed to be "surplus". NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing findings and recitals are true, correct, and incorporated herein. 2. Real Property located west of Canteria Drive and north of State Highway 178 is hereby declared surplus to the City's needs and the Finance Director is authorized to negotiate its sale and disposition.
