HomeMy WebLinkAboutRES NO 080-11 RESOLUTION NO. 0 ®0 - 1 1 A RESOLUTION DECLARING REAL PROPERTY SURPLUS TO THE NEEDS OF THE CITY AND AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE ITS SALE WHEREAS, the City owns a fee simple interest in property located between Union Avenue West Loop Road and the northern right of way line of the Southern Pacific Railroad; and, WHEREAS, Hopper Properties, LLC, a California limited liability company has requested the City sell this property described in Exhibit "A" attached hereto to facilitate their development. WHEREAS, the Bakersfield Planning Department found the sale of this property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to Government Code Section 65402. WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale of City property deemed to be "surplus". NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing findings and recitals are true, correct, and incorporated herein. 2. Real Property located between Union Avenue West Loop Road and the northern right of way line of the Southern Pacific Railroad is hereby declared surplus to the City's needs and the Finance Director is authorized to negotiate its disposition. Exhibit "A" the following described real property in the City of Bakersfield, county of Kern state of California: and being a portion of Section 30, Township 29 South, Range 28 East, M.D.M., and as per "Map of the City of Bakersfield", filed for record November 25, 18982 in Book I of Maps at pages 13 and 14, in the office of the County Recorder of said Kern County and more particularly de- scribed as follows: For the purpose of the following description the centerline of said 24th Street is assumed to bear N.89°56143"W. Beginning at the intersection of the northerly boundary line of said 24th Street of 82.5 feet in width, with the westerly boundary line of Union Avenue of 115.5 feet in width, and as said intersection is shown on said "Map of the City of Bakersfield"; THENCE (1) N.0°01'230!E., along said westerly boundary line of Union Avenue, a distance of 51.403 feet, to a point from which the radial center of the following described curve bears N.89°58137"W., distant 12.00 feet; THENCE (2) southwesterly along said 'curve, concave to the northwest, with a radius of 12 feet, through a central angle of 67°33'27" a distance of 14.149 feet to a point of tangency, from which the radial cotter of last rested curve bears 1.22.25110"W. , distant 12.00 feet; THENCE (3) S.67°34'50'V., along a tangent line a distance of 34.165 feet to a point, from which the radial center bf the following described curve bears 1.22°25'10"W., distant 358.75 feet; THENCE (4) southwesterly along last named curve, concave to the northwest, with a radius of 358.75 feat, and through a central angle of 19°05'4011, a distance of 119.557 feet to a point, from which the radial center of said last named curve bears N.3°19130"W., distant 358.75 feet; THENCE (5) S.0003117"W., to intersect the said northerly boundary line of 24th street, a distance of 0.624 feet; THENCE (6) S.89°56'43"E., along said northerly boundary line of 24th Street a distance of 155.00 feet, to intersect the westerly boundary line of said union Avenue, the point of beginning, containing 2610.41 square feet or, 0.05992 acres of land, more or less.
