STAFF RECOMMENDATIONS SHOWN IN CAPS AND UNDERLINED * APPROVE minutes for the MBHCP Implementation Trust Group Special meeting of May 1. 26, 2011. For each property listed below, staff 2.*Purchase of Habitat Mitigation Land: recommendation is as follows, with the specific purchase price recommendation listed with the property below: (1) MAKE FINDING THAT THE ACQUISITION IS CATEGORICALLY EXEMPT PURSUANT TO §15313 OF CEQA; (2) UPON (A) SELLER’S SIGNING OF A MEMORANDUM OF SALE AND ESCROW; AND (B) STAFF’S RECEIPT OF DOCUMENTATION FROM CDFG INDICATING CDFG’S INTENT TO ACCEPT TITLE TO THE PROPERTY AT THE CLOSE OF ESCROW, AUTHORIZE CITY OF BAKERSFIELD FINANCE DIRECTOR TO ISSUE WARRANT IN AMOUNT SUFFICIENT TO COVER PURCHASE PRICE; ESCROW COSTS; INCENTIVE INTEREST OF .583% OF SALE PRICE PER MONTH UNTIL THE RECORDATION OF A MEMORANDUM OF SALE AND ESCROW; REAL ESTATE TAXES FOR PERIOD WHICH THE MBHCP IS RESPONSIBLE; AND PRO RATA LIABILITY INSURANCE UNTIL THE CLOSE OF ESCROW, IF APPLICABLE, TO TICOR TITLE COMPANY FOR THE PURPOSE OF PAYING THE SELLER IN ACCORDANCE WITH THE SIGNED MEMORANDUM OF SALE AND ESCROW; (3) WITHIN 30 DAYS FOLLOWING CLOSE OF ESCROW, TRANSFER MBHCP Implementation Trust Group Page 2 Hearing Agenda July 21, 2011 THE APPROPRIATE AMOUNT TO CDFG FOR ENHANCEMENT; AND WITHIN 6 MONTHS FOLLOWING CLOSE OF ESCROW, TRANSFER THE APPROPRIATE AMOUNT TO CDFG FOR ENDOWMENT, and; a) *APN 099-200-06 (5 acre site)— being a portion of the S ½ of the NE ¼ of Section 11, T29S, R22E, MDM, County of Kern; located 2.58 miles northwest of the intersection of State Highway 58 and Lokern Road. The property is owned by Rene and Rosario and the proposed purchase price is $5,500 to be acquired by the State of Canlas California. APPROVE ACQUISITION AT PURCHASE PRICE OF $5,500. b) *APN 047-034-03 (10.15 acres), APN 047-034-05 (1.23 acres), and APN 047-034-08 (2.36 acres) – being a portion of the SE ¼ of Section 1, T25S, R24E, MDM, (13.74 acres total) County of Kern; located approximately 0.60 miles NW of the intersection of West Cecil Avenue and Wasco Pond Road. The property is owned by and Helen Rosario the proposed purchase price is $22,671 to be acquired by the State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $22,671. c) *APN 047-020-49 (5.03 acre site) – being a portion of the NE ¼ of Section 1, T25S, R24E, MDM, County of Kern; located approximately 0.75 miles NW of the intersection of West Cecil Avenue and Wasco Pond Road. The property is owned by Michael and and the proposed purchase price is $7,545 to Salle Tomasini and Nancy Comstock be acquired by the State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $7,545. d) *APN 099-170-04 (2.5 acres) and APN 099-170-30 (1.25 acres) – being (3.75 acres total) a portion of the N ½ of the SE ¼ of Section 10, T29S and R22E, MDM, County of Kern; located 3.6 miles northwest of the intersection of State Highway 58 and Lokern Road. The property is owned by and the proposed purchase price is $4,500 to Paul Frame be acquired by the State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $4,500. e) *APN 102-190-39 (1.5 acre site)— being a portion of the N ½ of the NE ¼ of Section 32, T29S, R23E, MDM, County of Kern; located 2.2 miles southeast of the intersection of State Highway 58 and Lokern Road. The property is owned by and the Karen Holmes proposed purchase price is $3,434 to be acquired by the State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $3,434. g) *APN 099-070-22 (2.5 acre site)— being a portion of the N ½ of the SE ¼ of Section 10, T29S, R22E, MDM, County of Kern; located 3.37 miles northwest of the intersection of State Highway 58 and Lokern Road. The property is owned by Robert (Jr.) and and the proposed purchase price is $3,000 to be acquired by the Elisabeth Liske State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $3,000. h) * APN 046-220-06 (2 acre site) – being a portion of the W ½ of the NE ¼ of Section 26, T25S, R23E, MDM, County of Kern; located approximately 1 mile NE of the intersection of Rowlee Road and Pond Road. The property is owned by Roy and and the proposed purchase price is $3,000 to be acquired by the Delores Smith State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $3,000. i) * APN 046-120-09 (2.5 acre site) – being a portion of the NE ¼ of Section 18, T25S, R23E, MDM, County of Kern; located along the south side of Garces Hwy, approximately 2 ½ miles east of Corcoran Road. The property is owned by John Grizzle and Anne and the proposed purchase price is $4,125 to be acquired by the State of Baron California. APPROVE ACQUISITION AT PURCHASE PRICE OF $4,125. j) * APN 047-040-20 (40 acre site) – being a portion of the NW ¼ of Section 3, T25S, R24E, MDM, County of Kern; located approximately 1.5 miles NW of the intersection of West Cecil Avenue and State Highway 43. The property is owned by Allan and Rosa and the proposed purchase price is $57,200 to be acquired by the State of Joya California. APPROVE ACQUISITION AT PURCHASE PRICE OF $57,200. k) *APN 047-034-02 (2.56 acre site) – being a portion of the SE ¼ of Section 1, T25S, R24E, MDM, County of Kern; located approximately 0.60 miles NW of the intersection of West Cecil Avenue and Wasco Pond Road. The property is owned by and the proposed purchase price is $3,840 to be acquired by Walter Dunbar the State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $3,840. MBHCP Implementation Trust Group Page 4 Hearing Agenda July 21, 2011 l) * APN 099-062-14 (2.5 acres), APN 099-150-08 (2.5 acres) and APN 099-340-17 (2.5 acres) – being a portion of the SW ¼ of Section 24, T29S and R22E, of (7.5 acres total) the N ½ of the SW ¼ of Section 10, T29S and R22E and of the S ½ of the NW ¼ of Section 2, T29S and R22E, respectively, MDM, County of Kern; located 3.5 miles northwest, 4.2 miles northwest and 1.7 miles southwest, respectively, of the intersection of State Highway 58 and Lokern Road. The property is owned by John and the proposed purchase price is $9,000 to be acquired by the State of Denney California. APPROVE ACQUISITION AT PURCHASE PRICE OF $9,000. m) * APN 099-250-18 (2.89 acre site)— being a portion of the N ½ of the NW ¼ of Section 4, T29S, R22E, MDM, County of Kern; located 5.3 miles northwest of the intersection of State Highway 58 and Lokern Road. The property is owned by and the Scott Turney proposed purchase price is $3,468 to be acquired by the State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $3,468. APPROVE request to reimburse Mitch Van Wyk for the purchase of an annual 3.* subscription of Kerndata.com property database information for $440 to aid in property acquisition. 4. Adjustment in Cost per Acre of previously approved property purchase a) *APN 046-161-09 (3.82 acres) — being a portion of S ½ of SE ¼ of Section 23, T 25 S, R 23 E, MDM, County of Kern; located approximately 1.14 miles northeast of the intersection of Rowlee Road and Pond Road. The property is owned by Don Gilbert and the proposed purchase price is $7,500 to be acquired by the State of California. Price per acre is $1,964. APPROVE ACQUISITION AT PRICE PER ACRE OF $1,964. APPROVE AND PRESENT a Resolution to Ted James for recognition of service as 5. Implementation Trust Group Board Member and for his contributions in the implementation of the Metropolitan Bakersfield Habitat Conservation Plan. Public Presentations This portion of the meeting is reserved for persons to address the Implementation Trust Group on any matter not on this agenda but under the jurisdiction of the Implementation Trust Group. The Implementation Trust Group members may respond briefly to statements made or questions posed. They may ask a question for clarification and make a referral to staff to report back to the Implementation Trust Group at a later meeting. Also, the Implementation Trust Group may take action to direct the staff to place a matter of business on a future agenda. Speakers are limited to two minutes. Implementation Trust Group Member Announcements or Reports On their own initiative, Implementation Trust Group members may make a brief announcement or a brief report on their own activities. They may ask a question for clarification, make a referral to staff or take action to have staff place a matter of business on a future agenda (Gov. Code §54954.2 (a)). ADJOURN TO CLOSED SESSION CLOSED SESSION The Metropolitan Bakersfield Habitat Conservation Plan Implementation Trust Group will 6. hold a closed session (Government Code §54956.8) to confer with and grant authority to its negotiators (Martin Ortiz, Mitch Van Wyk, and Don Anderson) regarding the purchase of real property. The closed session involves the property identified below: a) APN 333-040-12 (53.51 acres)—being a portion of the S ½ of Section 34, T24S, R24E, MDM, ; located approximately 2.5 miles NW of the intersection of County of Tulare West Cecil Avenue and State Highway 43. The property is owned by Martinez .
