3. CONSENT CALENDAR
A. Consent Calendar Non - Public Hearing Items:
1. Minutes of the regular meeting held March 9, 2010.
Motion by Lee to approve non - public hearing items.
S. Public Hearing Items:
1. File No. 10 -0113 — Approval of a conditional use permit to
construct an aquatic facility and to eliminate 22 parking stalls
on the Garces Memorial High School campus in an R -1 (One -
Family Dwelling) zone district located at 2800 Loma Linda
Drive.
2. File No. 10 -0125— Approval of a conditional use permit to
construct a 9,500 square foot multi - tenant commercial building
to accommodate a 5,700 square foot retail jewelry store and
3,800 square feet of office space in a C -O (Professional and
Administrative Office) zone district located at 9450 Ming
Avenue.
3. File No. 10 -0131- Approval of a zoning modification to waive
the requirement to construct a six -foot high masonry wall
adjacent to a fire station /public greenbelt area in a residential
zone district in conjunction with the development of a retail
center in a C -2 (Regional Commercial) zone district located at
11300-11420 Ming Avenue.

Motion by Underwood to approve public hearing items 3.B.1 through
3.B.3.
PUBLIC HEARINGS
4. -I. File No. 09 -0767 - A conditional use permit to operate a 3,177
square foot bar with outdoor sE�ating in a C -1 (Neighborhood
Commercial) zone district located at 4715 Coffee Road.
Continued from March 9, 2010.
Fred Porter, neighboring commercial property owner, spoke in opposition.
Harold Robertson, neighboring commercial property owner, spoke in
opposition.
Tony Hogg, neighboring commercial property owner, spoke in opposition.
Mark Smith of Grubb & Ellis spoke in opposition.
Sue Porter, neighboring residential property owner, spoke in opposition.
Bob Sherfy, attorney representing the applicant, spoke in favor.
Board discussion.
Motion by Lee to approve public hearing item 4.1 with the addition of
conditions of approval prohibiting outdoor seating and all other
outdoor bar - related activity, requiring windows to be tinted and/or
treated with materials which visually obscure activities within the
premises, and limiting the maximum hours of operation the
establishment may be open to the public to 12 :00 p.m. to 12 :00 a.m. on
Sunday, 2 :00 p.m, to 12 :00 a.m. Monday through Thursday, 2 :00 p.m, to
2 :00 a.m. on Friday, and 12 :00 p.m, to 2 :00 a.m, on Saturday.
