ROLL CALL Present: Board Members Barnhard, Lee, Underwood Absent: 2. PUBLIC STATEMENTS None 3. CONSENT CALENDAR A. Consent Calendar Non - Public Hearing Items: 1. Minutes of the regular meeting held August 10, 2010. Motion by Lee to approve non - public hearing items. B. Public Hearing Items: 1. File No. 09 -0315 - Approval of a conditional use permit to operate a concrete and asphalt recycling facility on an 11.24 -acre site in an M -3 (Heavy Industrial) zone district located at 75 E. White Lane. 2. File No. 10 -0402 - Approval of a conditional use permit to develop a 6.5 -acre water treatment plant, including a 32- foot tall reservoir tank, treatment facilities, pump station, and an administrative building in an A (Agricultural) zone district located at 4403 and 4601 Pacheco Road. 3. File No. 10 -0415 - Approval of a zoning modification to reduce the required rear yard setback from 7 to 0 feet and to reduce the required parking from 6 to 3 spaces to convert a 1,573 square foot residence to an office building in a C -0 (Professional and Administrative Office) ACTION TAKEN APPROVED CONTINUED REMOVED RES 10 -29 BZA Minutes 9%14/10 Page 2 REGULAR MEETING zone district located at 505 H Street. 4. File No. 10 -0417 - Approval of a conditional use permit to operate a 30 -bed residential facility with three staff members and a zoning modification to reduce the parking requirement from 18 to 12 spaces in an R -2 (Limited Multiple - Family Dwelling) zone district located at 404 S. Williams Street. The public hearing was opened. Item 3.B.1. was requested to be continued by the applicant via written request. Item 3.B.2. was requested to be removed by a member of the public. The public hearing was closed. Motion by member Underwood to continue item 3.B.1. to October 12, 2010, and to approve items 3.B.3. and 3.B.4. 4. PUBLIC HEARINGS 1. File No. 10 -0402 - Approval of a conditional use permit to develop a 6.5 -acre water treatment plant, including a 32 -foot tall reservoir tank, treatment facilities, pump station, and an administrative building in an A (Agricultural) zone district located at 4403 and 4601 Pacheco Road. The public hearing was opened and the staff report was given. Spoke in favor of the staff recommendation: Tim Treloar of California Water Service Company, applicant Spoke in opposition to the staff recommendation: Jeff and Roma Jean Baird, neighboring property owners, expressed concerns regarding potentially adverse effects of the facility upon their single - family residence located at 4200 Thatch Avenue. Upon learning more about the specifics of the proposed facility, they expressed that the majority of their concerned had been alleviated, particularly with the ACTION TAKEN � HIMCRI APPROVED BZA Minutes 9/14/10 Page 3 REGULAR MEETING applicant's agreement to increase the height of the masonry wall along the southern boundary of the site to 7 feet. The public hearing was closed. Board discussion. Motion by Member Underwood to approve public hearing item 4.1. as modified by the applicant with respect to perimeter wall height. 5.
