Dear Dr. Gallagher,
I'm responding to your letter of June 8, 2010 where you've brought to our attention
that inspection fees may have been paid for certain years when the Bakersfield Fire
Department was unable to complete an annual Hazardous Materials inspection during
that year.
Thank you for bringing this to our attention. I've reviewed the billing history and
compared it with the Hazardous Materials inspection records for your practice. You
are due an additional refund of $96 for an inspection charge posted in Fiscal Year
2007 -2008 when the annual inspection was unable to be performed that year.
The $96 will now be credited to your account at the City Finance Department.
The billing history shows similar adjustments have been made for prior years. Most
recently, on May 28, 2010, a $96 credit was issued for Fiscal Year 2008 -2009 when
the inspection was unable to be performed last year. You will now be credited an
additional $96 for the prior Fiscal Year 2007 -2008, as mentioned above.
There was, however an inspection conducted on April 16, 2007 for the Fiscal Year
2006 -2007 inspection charge. No adjustment was necessary for that inspection fee.
You were not charged any inspection fees during Fiscal Years 2005 -2006, 2004 -2005,
and 2003 -2004. You were previously credited $53 for an inspection fee (in that
amount at that time) during Fiscal Year 2002 -2003. An inspection was performed on
November 11, 2001 for the Fiscal Year 2001 -2002 inspection fee.
There are annual Hazardous Materials fees assessed which are not strictly inspection
related, but are operating permit fees and state surcharges. No payment has been
received to date for either of the Fiscal Years 2008 -2009 and 2009 -2010 Hazardous
Materials / Hazardous Waste and State surcharge portions of the annual fee.
Many medical practices have recently converted to a digital x -ray process in order to
eliminate the x -ray development chemicals and hazardous waste.on site, and have
thereby become exempt from annual Hazardous Materials permit fees and periodic
inspections. Please contact me if there are any changes to your x -ray process which
would qualify for this exemption.
With the above referenced credit of $96, the outstanding balance will be reduced
accordingly. A new invoice will be sent to you in that adjusted amount. As
requested, the billing and inspection records for your practice are also enclosed.

In my 10+ yrs of having this office, . I have had a Hazardous Materials Annual Inspection
performed 4 times, yet I have been billed every year. I have paid every year for.services that
were not rendered. This being said, until I have proof that the services have been rendered, I will
not be paying for the inspections that did not occur. In addition, I expect a full refund of the
payments made in previous years in which an inspection was not performed. Please contact my
office with any questions. Thank You.
