I looked into this. I think Ernie is citing the wrong code here. The 3403.6.4 is out of the general Ch 34
Flammable & Combustible Liquids chapter. This installation is a gas station vent system &.is more
particularly governed by Ch 22 "Motor Fuel Dispensing Facilities." Sec 2206.7.9.2 specifically pertains to
vapor processing systems and reads, "Processing equipment shall be protected against physical damage
by guardrails, curbs, protective enclosures or fencing." This installation has a protective enclosure which
meets the code reqm't for "protective enclosures" under 2206.7.9.2. See photo.
Citing Ch. 34 and it's reference to crash posts is wrong because the vapor vent pipes are not flowing
flammable liquids. The correct Ch. 22 reqm't is less onerous because it's specifically drafted for this
particular application, and is therefore the proper code to use, which this installation meets. I'm not really
in favor of making businesses arbitrarily comply with codes that don't apply. Agreed?

letting me know what is going on and is especially appreciated if my name and phone number is offered
which gives me a heads up on the issue. I know you will handle this problem and I appreciate that fact.
I do want to know if we are getting complaints from the public. I understand that we are not liable for any
omissions, but I am concerned that there was an omission. I know we cannot be perfect a hundred
percent of the time, but that should be our goal.

I inspected the Hirt (EVR) install and I wrote a correction notice #005191- Need to add crash post to
protect the EVR system from vehicle impact. (CFC 312.2). A 96.00 dollar reinspection fee. must be paid
and receipt in hand prior to me coming back out for a reinspection

There's also the Liability sec. 103.4, that when acting in good faith, the fire code official "is hereby relieved
from all personal liability for any damage accruing to persons or property as a result of an act or by
reason of an act or omission in the discharge of official duties."
Then there's the issue of why my staff feels continually compelled to go over my head directly to you
every time any issue comes to a head. Is that an issue, or is it just me?

Ernie, my confusion is over why you don't check those codes before issuing permits. Over here on the
contractor side we have to help customers understand the cost of projects so they can run businesses. It
not as easy as just asking for more money. I believe you can appreciate these challenges and the
permitting process is the right time for these issue to come up.
We aren't upset, but we should be able to ask a public office what happened without getting a sarcastic
reply.
