A RESOLUTION DETERMINING THAT THE CITY
MANAGER OR HIS DESIGNEE IS APPOINTED AS
AGENT AUTHORIZED TO EXECUTE ANY ACTIONS
NECESSARY FOR THE PURPOSE OF OBTAINING
FEDERAL FINANCIAL ASSISTANCE PROVIDED BY THE
DEPARTMENT OF HOMELAND SECURITY AND SUB-
GRANTED THROUGH THE STATE OF CALIFORNIA TO
THE COUNTY OF KERN AND THROUGH THE COUNTY
OF KERN TO THE CITY OF BAKERSFIELD.
WHEREAS, the County is the designated sub-grantee for Homeland Security
Grants on behalf of the Kern Operational Area; and
WHEREAS, the City is part of the Kern Operational Area; and
WHEREAS, as required by Grant guidelines, the designated Anti-Terrorism
Approval Body ("Approval Authority") which is required to include the County Fire Chief,
the Sheriff, the Emergency Medical Services Department Director and a representative
from both the Kern Police Chiefs and Kern Fire Chiefs Associations, must approve grant
applications and expenditures of grant funds; and
WHEREAS, the Approval Authority has approved an allocation of FY2010
State Homeland Security grant funds to procure specialized equipment, software,
training or other professional services on behalf of the CITY, a local government within
the Kern Operational Area, to partially fund the City of Bakersfield Fire Department
Response and Equipment Project and the FY2010 MMRS Project; and
WHEREAS, acquisition of such equipment, software, training or other
professional services needed to complete the City of Bakersfield Response and
Equipment Project and FY2010 MMRS Project may require contractual waivers of
liability, mutual indemnification or other restrictive contractual requirements; and
WHEREAS, the COUNTY cannot sign such contracts on behalf of the CITY.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
The above recitals are true and correct and incorporated herein by
reference;
2. City Manager, Alan Tandy, or his designee is hereby authorized to
execute for and on behalf of the City of Bakersfield, a public entity established under the
laws of the State of California, any actions necessary for the purpose of obtaining
federal financial assistance provided by the Federal Department of Homeland Security
and sub-granted through the State of California to the County of Kern and through the
County of Kern to the City of Bakersfield.
