A RESOLUTION DETERMINING THAT CONSOLIDATION OF
MAINTENANCE OF IBM EQUIPMENT CANNOT BE
REASONABLY OBTAINED THROUGH THE USUAL BIDDING
PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR
TO DISPENSE WITH BIDDING THEREFOR, NOT TO EXCEED
$60,468.
WHEREAS, the City of Bakersfield uses numerous pieces of IBM computer
equipment including servers and the corresponding parts necessary to ensure
the computer systems run properly; and
WHEREAS, the City of Bakersfield must purchase maintenance contracts
for each individual piece of IBM Computer equipment to ensure that each
piece of equipment can be properly maintained and serviced; and
WHEREAS, due to the number of equipment involved, consolidation and
management of maintenance contracts is necessary to ensure that there are
no gaps in service, because of the critical nature of the equipment; and
WHEREAS, IBM has established a program whereby their certified Premier
Business Partners can now consolidate service invoices, and IBM has designated
Computer Configuration Services as the only certified Premier Business Partner
that can offer the City of Bakersfield the consolidation service; and
WHEREAS, IBM will not let any other certified partner bid on this contract;
any other bids will be considered "grey" market and will not be honored by IBM;
and
WHEREAS, the City Manager recommends the Council find that said
consolidation is necessary to ensure the successful operation of the City of
Bakersfield's computer systems and can only be reasonably obtained from
Computer Configuration Services, LLC, and recommends that the Council
authorize dispensing with bidding requirements in accordance with subsection
D.2 of Section 3.20.060 of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and incorporated herein by
reference.

2. The Council hereby finds that the consolidated IBM maintenance
can only be reasonably obtained from one supplier (Computer Configuration
Services, LLC) for the reasons set forth above.
3. The Finance Director is authorized to dispense with bidding therefor
in accordance with Subsection D.2 of Section 3.20.060 of the Bakersfield
Municipal Code and to negotiate the purchase of same, not to exceed $60,468.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
December 14, 2011, by the following vote:
