ROLL CALL Present: Board Members Bland, Fick, Underwood A. Consent Calendar Non - Public Bearing Items: 1. Minutes of the regular meeting held November 8, 2011. Motion by Member Fick to approve the non - public hearing item. 1. File No. 11 -0127 - Remove from the agenda a conditional use permit to construct a 65 -foot tall monopole wireless communications facility camouflaged as a pine tree with ancillary equipment in an R -1 -CH (One - Family Dwelling /Church) zone district located at 2801 Ashe road. 2. File No. 11 -0444- Approval of a zoning modification to reduce the required front yard setback from 10 to 8 feet, to reduce the rear yard building setback from 20 to 5 feet, and to waive the requirement for a 6 -foot tall masonry wall along the rear property boundary to allow for the construction of a 20,707 square foot retail building with a 70 -stall parking lot in a C -2 (Regional Commercial) zone district located at 401 Union Avenue. File No. 11 -0450 - Approval of a conditional use permit to operate a 6,373 square foot pawn shop in a C -1 (Neighborhood Commercial) zone district located at 4646 Ming Avenue. The public hearing was opened. Items 3.B.2. and 3.B.3. were removed from the consent agenda by members of the public. The public hearing was closed, with the exception of items 3.B.2. and 3.B.3. /Motion by Member Underwood to approve the removal of item 3.B.1. which was withdrawn by the applicant and to remove items 3.B.2. and 3.8.3. from the consent agenda, for discussion. _,`.r- 1. Duane Keathley, representing Dollar General, Max Bacerra, representing the applicant, and Kevin Williams, neighboring property owner, spoke in favor of the proposal. The public hearing was closed. File No. 11 -0450 - Conditional use permit to operate a 6,373 square foot pawn shop in a C -1 (Neighborhood Commercial) zone district located at 4646 Ming Avenue. Aman Sahamon, manager of two properties along American Avenue, spoke in opposition to the proposal. Michael Morin, applicant, Oscar 5altazar, representing the applicant, and Phil Fontes, representing the property owner, spoke in favor of the proposal. The public hearing was closed. Motion by Member Underwood to approve item 4.2. 3. File No. 11 -0436 - Zoning modification to permit two lattice covered structures, each supported by four 7 -foot, 8 -inch tall concrete columns, to exceed the maximum allowable front yard setback encroachment of 3 feet in an R -1 (8,500) (One - Family Dwelling - minimum 8,500 square foot lot area) zone district located at 309 Sonoma Vine Court. The public hearing was opened. Stacy Nichols, neighboring property owner, spoke in opposition to the proposal. John Hansen, applicant, spoke in favor of the proposal. The public hearing was closed. Motion by Member Underwood to deny item 4.3. Paul Hellman, Principal Planner, welcomed Member Bland and Andy Heglund, Associate City Attorney, to their first BZA meeting.
