AMENDMENT NO. 1 TO RESOLUTION NO.
036-11 FURTHER SUSPENDING APPLICATION
OF RESOLUTION NO. 118-05 TO ALLOW FOR
DISCRECTIONARY EXTENSIONS OF VESTING
RIGHTS IN SUBDIVSION MAPS.
WHEREAS, the Subdivision Map Act gives the City Council the discretion to
grant extensions of vesting rights in subdivision maps beyond what is granted by
statute; and
WHEREAS, on June 8, 2005, in order to achieve consistency in the
discretionary granting or denial of extensions of vesting rights by the City
Council, the City Council adopted Resolution No. 118-05, prohibiting the City
from granting discretionary extensions of vesting rights in subdivision maps; and
WHEREAS, on May 18, 2011, in an effort to spur economic development
and recovery in the City, the City Council adopted Resolution No. 036-11, a
copy of which is attached as Exhibit A, suspending the application of Resolution
No. 118-05 until April 30, 2012 to allow discretionary extensions of unexpired
vesting rights in subdivision maps that expire between May 18, 2011 and April 30,
2012; and
WHEREAS, on December 20, 2011, in a further and continued effort to spur
economic development and recovery in the City, the Housing Incentive Task
Force of the City Council recommended that the City Council extend
suspension of the application of Resolution No. 118-05 created by Resolution No.
036-11 until April 30, 2013; and
WHEREAS, it is the intent of City Council that, on May 1, 2013, this
Amendment No. 1 to Resolution 036-11 will become null and void and Resolution
118-05 will continue in full force and effect.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and incorporated herein by
reference.

2. Resolution No. 036-11 is hereby amended to extend the suspension
of the application of Resolution No. 118-05 until April 30, 2013 to allow for
discretionary extensions of vesting rights in subdivision maps if all of the following
are true:
a. The vesting rights in the subdivision map are set to expire
between May 18, 2011 and April 30,2013;
b. A request for extension of the vesting rights in the subdivision
map is properly submitted to the necessary City departments
prior to expiration of the map.
3. On May 1, 2013, if no other action is taken by this City Council,
Resolution No. 118-05 returns to full force and effect, and the City may not grant
discretionary extensions of vesting rights in subdivision maps beyond that
granted by state law.
