A RESOLUTION DETERMINING THAT
CHALLENGERS PLAYSCAPE PLAYGROUND
WITH SLIDES CANNOT BE REASONABLY
OBTAINED THROUGH THE USUAL BIDDING
PROCEDURES AND AUTHORIZING THE
FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFOR AND PURCHASE AND
INSTALL CHALLENGERS PLAYSCAPE
PLAYGROUND WITH SLIDES FROM DAVE BANG
ASSOCIATES, INC., NOT TO EXCEED
$40,000.00.
WHEREAS, CITY recently completed the installation of a playground at City in
the Hills Park; and
WHEREAS, CITY desires the design, supply, and installation of an additional
playground with slides, which was not part of the original playground install; and
WHEREAS, CITY desires an playground with slides to integrate with the existing
playground's theme, color scheme, and compatibility with the original supplier and
installer; and
WHEREAS, CITY contacted the original supplier and installer, Dave Bang
Associates, Inc., to design, supply and install the additional playground with slides;
and
WHEREAS, Dave Bang Associates, Inc. is the only installer that can completely
integrate the existing theme, color scheme, and compatibility of the additional
playground with slides to the existing playground at City in the Hills Park; and
WHEREAS, the additional playground with slides, to be provided by Dave
Bang Associates, Inc., will integrate with the existing theme, color scheme, and
compatibility with the existing playground at City in the Hills Park.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The design, supply, and installation can only be reasonably obtained
from Dave Bang Associate, Inc. because of the need to successfully integrate such OAKF
work, supplies, equipment or materials into the existing playground at City in the Hills
Park. o

3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for said work, supplies, equipment or material
shall not exceed Forty Thousand Dollars ($40,000.00).
I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held
on JAN 1 1 2012 , by the following vote:
