C 4; RESOLUTION NO. 029- 1 2 A RESOLUTION EXPANDING THE CITY OF BAKERSFIELD'S RECYCLING PROGRAM FOR RESIDENTIAL AND COMMERCIAL SOLID WASTE, AND ESTABLISHING NEW SOLID WASTE AND RECYCLING SERVICE LEVELS AND RELATED FEES. WHEREAS, the City operates a solid waste management system pursuant to the municipal code, using a combination of municipal and contract forces, and WHEREAS, said system is funded by service fees and other revenues within the Refuse Enterprise Fund; and WHEREAS, California state law requires local jurisdictions to maintain a minimum 50% recycling rate for solid waste generated within the jurisdiction; and WHEREAS, the City has attained a 61% recycling rate in recent years; and WHEREAS, new legislation (Assembly Bill 341) has set a state policy goal of 75% recycling by the year 2020, and establishes a mandatory commercial recycling requirement as of July 2012; and WHEREAS, the State of California has determined that increased levels of recycling and composting are necessary to achieve State goals related to greenhouse gas generation; and WHEREAS, the City's solid waste management system currently provides individual residences with weekly refuse collection and green waste composting as a basic service level; and WHEREAS, the City's solid waste management system currently provides individual residences with every other week curbside recycling service on an optional fee basis; and WHEREAS, the City Council desires to include curbside recycling service within the basic service level for all individual residences, duplexes, and triplexes without said optional fee; and WHEREAS, the Refuse Enterprise Fund has adequate reserves to implement said curbside recycling service citywide; and ,Y CJ 3 WHEREAS, the City's solid waste system is prepared to provide for the needs of the business community as it complies with Assembly Bill 341, by making available new fee -based commercial recycling and composting services, as shown on Exhibit "A ", for businesses to choose from as needed. NOW, THEREFORE, The City of Bakersfield hereby expands its Recycling Program as shown on Exhibit "A" to include: 1. Curbside recycling as part of the basic service level covered by the current residential refuse collection fee. 2.
