RESOLUTION NO. R' A 7-0 3
A RESOLUTION OF THE BAKERSFIELD
REDEVELOPMENT AGENCY AUTHORIZING
CONTRACTS NOT TO EXCEED TWENTY -FIVE
THOUSAND DOLLARS TO BE EXECUTED WITHOUT
FORMAL AGENCY ACTION.
WHEREAS, California redevelopment law authorizes redevelopment agencies to
enter into various types of contracts; and
WHEREAS, typically, such contracts are either disposition and development
agreements, owner participation agreements or professional service /consultant
agreements; and
WHEREAS, the Bakersfield Municipal Code does not require contracts which
obligate the City of Bakersfield to spend less than twenty -five thousand dollars to be
brought before the City Council for formal action as long as the contracts are approved
as to form and content and signed by the Mayor, the City Attorney, a department head
and the Finance Director; and
WHEREAS, most professional service /consultant contracts are related to
particular projects, and, therefore, would not exceed twenty -five thousand dollars; and
WHEREAS, since the staff of the Agency are also the staff of the City of
Bakersfield, it would ensure consistency in application of policies if the Agency gave its
staff the same authority to enter into contracts of less than twenty -five thousand dollars
as the City of Bakersfield has done.
NOW, THEREFORE, BE IT RESOLVED BY THE BAKERSFIELD
REDEVELOPMENT AGENCY as follows:
The above recitals are true and correct;
2. Agency staff is hereby authorized to execute contracts wherein the
financial obligation of the Agency does not exceed twenty -five thousand
dollars ($25,000.00), provided that such contracts are signed by the
Agency chairperson or vice - chairperson, approved as to form and signed
by the General Counsel or designee, approved as to content and signed
by the Executive Director or designee and signed by the Finance Officer
or designee.
