AMENDMENT NO. 1 TO RESOLUTION NO. 069 -11
ADOPTING THE HOOPER AVENUE AND KIMBERLY AVENUE
PLANNED SEWER AREA AND MAKING FINDINGS RELATIVE
THERETO. (WARD 4)
WHEREAS, Chapter 16.32.060.E of Title 16 of the Bakersfield Municipal Code
and Section 66483 of the California Government Code, provide for a procedure
by which the City Council may assess and collect fees for the purpose of
defraying the cost of constructing sewer facilities for local and neighborhood
sewer areas;
WHEREAS, on July 13, 2011, the Council of the City of Bakersfield adopted
Resolution No. 069 -11, adopting the Hooper Avenue and Kimberly Avenue
Planned Sewer Area and apportioning the fees for constructing the related
sewer facilities for two areas annexed to the City on December 17, 2008 and
June 28, 2009 as shown on the map entitled "Hooper Avenue & Kimberly
Avenue Planned Sewer Area" attached as Exhibit "B" to Resolution No. 069 -11;
WHEREAS, the fees and charges for constructing the related sewer
facilities were set forth in Exhibit "A" to Resolution No.069 -11 and were based on
the actual bid cost for constructing those sewer facilities;
WHEREAS, the final project cost for the Kimberly- Hooper Sewer
Improvement Project, Contract No. 11 -049, was lower than the original bid cost
stated in Exhibit "A" to Resolution No. 069 -11 because the Contractor who
completed the work was subject to liquidated damages under Contract No. 11-
049 and related Contract Change Order No, 1;
WHEREAS, the final project cost under Contract No. 11 -049 was
$793,270.03, resulting in a $92,679.57 reduction in the cost to construct the sewer
facilities; and
WHEREAS, the Cost per Single Family Dwelling has decreased because of
the reduction in the cost to construct the sewer facilities, necessitating an
amendment to Exhibit "A" to Resolution No. 069 -11 to reflect the new cost to
construct the sewer improvements, Cost per Single Family Dwelling, and fee
increase schedule.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
The above recitals are true and correct and incorporated herein by
reference.

2. Resolution No. 069 -11 is hereby amended to replace Exhibit "A" to
Resolution No. 069 -11 with the attached revised Exhibit "A ".
3. Except as amended herein, all other provisions of Resolution No.
069 -11 remain in full force and effect.

by the Council of the City of Bakersfield at a regular meeting thereof held on
