A RESOLUTION PROVIDING FOR THE
COLLECTION OF SEWER AND STORM SEWER
SERVICE USER CHARGES BY THE KERN
COUNTY AUDITOR - CONTROLLER'S OFFICE
WHEREAS, Chapter 14.12 of the Bakersfield Municipal Code authorizes the
establishment and increase of sewer user fees and charges to recover costs for
services rendered; and
WHEREAS, the City has calculated the annual rate for sewer user fees; and
WHEREAS, the fees and charges set forth in Exhibit "A," attached hereto
and incorporated by reference, do not exceed the reasonable estimated cost
of providing the services for which the fees are charged; and
WHEREAS, the City Council has determined that the collection of said
charges is necessary for Fiscal Year 2012/2013, and that the rates set by City
Council action on June 8, 2011 for Fiscal Year 2011/2012 will continue and not
be increased for Fiscal Year 2012/2013.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals and findings are true and correct and are
incorporated herein by reference.
2. The fees and charges set forth in Exhibit "A" are hereby adopted
and shall become effective on July 1, 2012.
3. The adoption of these fees and charges complies with Proposition
218.
4. Pursuant to the Bakersfield Municipal Code, the fees and charges
herein shall be collected by the Kern County Tax Collector on the
property tax rolls.

All outside users pay the some annual user fee as City residents. In addition, a surcharge fee is
assessed to cover capacity charge for reserving a portion of City's trunk line and sewage treatment
facilities and a capital charge for recovering of subsequent City capital costs.

The rates contained in this exhibit cover 100% of costs reasonably incurred in providing the
operation, maintenance, replacement, and capital improvements of the existing wastewater
plants, sewers, and storm sewer systems. Ninety -four and a half (94.5) percent of said rates are
attributable to sanitary sewer use, maintenance, replacement and improvements and five
and a half (5.5) percent of said rates are attributable to storm sewer use , maintenance,
replacement and improvements.

Note: Users may be charged cost recovery fees when discharges are monitored for
compliance to regulatory requirements. Costs may include, but are not
limited to outside commercial laboratory fees, city staff hourly rates and fringe
benefit costs, equipment costs, reimbursement for damages, administrative costs,
overhead costs and other costs incurred by the City.
