(ALLWARDS) WHEREAS, Chapter13.04ofTitle13oftheMunicipalCodeoftheCityof BakersfieldprovidesforanalternativeprocedurebywhichtheCityCouncilmay provideforthepaymentofalloranypartofthecostsandexpensesofmaintainingand operatinganypublicimprovementswhicharelocalinnature, fromannualbenefit assessmentsapportionedamongtheseverallotsorparcelsofpropertywithinthe maintenancedistrictestablishedtherefore; WHEREAS, thePublicWorksDirectorhasfiledhisreportassetforthinExhibit 1, attachedheretoandincorporatedbyreferenceherein, includingthe2012 -2013 budgetfortheConsolidatedMaintenanceDistrictwiththeCityClerk'sOffice, as requiredbySection13.04,130oftheBakersfieldMunicipalCode; WHEREAS, theCityClerkhasfiledinherofficeaffidavitssettingforththe compliancewiththerequirementsofChapter13.04oftheBakersfieldMunicipalCode concerningpublishingnoticeofthehearingontheConsolidatedMaintenanceDistrict; andsaidCityCouncilherebyfindsthatsaidnoticehasbeenpublishedinthemanner requiredbylaw; WHEREAS, theabovehearingwasdulyheldbytheCityCouncilatthe timeandplaceforhearingproteststotheboundariesofthedistrict, thefairnessofthe benefitformula, thezonesofbenefitincludingtierlevel, thereservationofrightofthe CitytoutilizeeitherCityforcesortocontractwithprivateindustryfortheoperationand maintenanceoftheimprovements, ortheamountoftheassessmentonanyparcelof propertytobeassessed; and WHEREAS, anywrittenprotestsfiledwiththeClerkatorbeforethetimeset forsaidprotesthearingwereconsideredbysaidCouncil, asfollows; NOW, THEREFOREBEITRESOLVEDbytheCounciloftheCityofBakersfield 1. Theforegoingrecitalsarefoundtobetrueandcorrectandare incorporatedherein, 2. TheCouncilfindsanddeterminesthat, forpurposesofthemajority protestprovisionsofSection13.04.200oftheBakersfieldMunicipal Code, therewerenotsufficientprotestsreceivedand, therefore, thereisnotamajorityprotest. The2012 -2013BudgetfortheConsolidatedMaintenanceDistrictis attachedheretoasExhibit "B" andincorporatedbyreferenceasthoughfullysetforthherein. PursuanttotheprovisionsofChapter13.04ofTitle13oftheMunicipalCodeoftheCityof Bakersfield, thePublicWorksDirectormakesandfilesthisReportandproposedassessmentof anduponallparcelsofpropertywithintheareasofthedistrictforthecostofmaintainingand operating publicparks, publicstreetmediansand otherpublicstreet landscaping improvements. The improvementsfortheConsolidatedMaintenance DistrictStreet LandscapingZoneofBenefitgenerallyinclude, butarenotlimitedto: PublicStreet LandscapingImprovementsconsistingof: turf, plantforms, shrubs, groundcover, trees, lighting, irrigationsystems, conduits, watermains; andPublicStreetMedianImprovementsconsistingof: turf, plantforms, shrubs, groundcover, trees, irrigationsystems, conduitsandwatermains. The improvementsfortheConsolidatedMaintenanceDistrictParkZoneofBenefitgenerally include, butarenotlimitedto: turf, plantforms, shrubs, groundcover, trees, irrigationsystems, conduits, watermains, playgroundequipment, picnictables, drinkingfountains, barbecuepits, securitylightingandrestrooms. TheimprovementsinthisConsolidatedMaintenanceDistrictareofapublicnature. The assessmentincludesthe costofnecessary repairs, replacements, water, equipment, electricity, care, supervisionandanyand allotheritemsnecessaryforthe proper maintenanceandoperationthereof. Formanyyears, parks, streetmediansandotherstreetlandscapingimprovementsinthe Cityweremaintainedthroughtraditionaltaxrevenues, AfterthepassageofProposition13in 1978, fundsavailableformaintenanceandoperationoflocalpublicimprovementswere substantiallyreduced. AtpresenttheCity'sbudgetdoesnotallowforthecostofall maintenanceandoperationoflocalpublicimprovementsofthetypesdescribedabove. Thus, withoutfundsformaintenanceandoperatingcostsfromasourceotherthangeneraltax revenues, theCitydoesnotpermitnewparks, publicstreetmedianorotherpublicstreet landscapingimprovementstobeconstructedwithintheCity. Thefundsgeneratedasthe resultofthisdistrictareutilizedstrictlyforthepurposeofandappliedtothemaintenanceand upkeepofpublicparks, publicstreetmedianandotherpublicstreetlandscapingwithinthe district, TheConsolidatedMaintenanceDistricthasbeenspecificallydesignatedtoaddress parkmaintenanceandoperation, andmaintenanceofpublicstreetmedianandotherpublic streetlandscapingimprovementsandallparcelswithinthedistrictareaffected. TheareaswithintheboundaryoftheConsolidatedMaintenanceDistrictreceivebenefits fromtheimprovements and maintenancethereof. Thebenefits ofthestreetlandscapinginuretoalllotsorparcelsuniformly, andarebasedonanEquivalent DwellingUnitbasis, inaccordancewithExhibit "A" ofeachterritoryhereof. ParkuseisabenefitmostlikelytobeenjoyedbyeachresidentintheParkZoneofBenefit. Thesebenefitsare, therefore, uniformlyassessedonanEquivalentDwellingUnitbasis. No assessmentforparkbenefitsismadeonnon - residentiallots. ThebenefitformulafortheConsolidatedMaintenanceDistrictissetforthinExhibit "C" of eachterritory, andisonfileintheofficeoftheCityClerk. Historically, theCityhasidentifiedthecostsofstreetandmedianlandscapingandpark maintenanceamenitiesthatarenotwithintheboundariesoftheConsolidatedMaintenance DistrictandarethereforepaidforoutoftheGeneralFund, TheCitythenprovidedasubsidy toparcelswithintheConsolidatedMaintenanceDistrictuptotheamountofthosecosts (i.e„ asof1996, a66% subsidyforparkmaintenancecostsand73% forstreetandmedian landscapemaintenancecosts). AfterthepassageofProposition218in1996, theCityhasnot raisedassessmentrates withinthe ConsolidatedMaintenanceDistrict eventhough maintenancecostshaverisen. Consequently, thesubsidiestoparcelswithintheConsolidated MaintenanceDistricthavecontinuedtorisesince1996, OnJanuary12, 2005, theCityCouncilpassedResolutionNo. 019 -05adoptingCouncilPolicy onParkMaintenanceandStreetLandscapingAssessmentswhichenablestheCitytocollect additionalrevenueforthemaintenanceofstreetandmedianlandscapingandpark maintenancewithintheConsolidatedMaintenanceDistrict. AsofJanuary12, 2005, allnewterritoriesaddedtotheConsolidatedMaintenanceDistrict thatbenefitfrompublicparksand /orstreetlandscapingshallbeassessed, consistentwiththe requirementsofProposition218, thoseamountssetforthinExhibit "A" ofResolutionNo. 019 -05.
