(ALLWARDS) WHEREAS, Chapter13.04ofTitle13oftheMunicipalCodeoftheCityof BakersfieldprovidesforanalternativeprocedurebywhichtheCityCouncilmayprovidefor thepaymentofalloranypartofthecostsandexpensesofmaintainingandoperatingany publicimprovementswhicharelocalinnature, fromannualbenefitassessmentsapportioned amongtheseverallotsorparcelsofpropertywithinthemaintenancedistrictestablished therefore; and WHEREAS, thePublicWorksDirectorhasfiledhisreportassetforthinExhibitI, attachedheretoandincorporatedbyreferenceherein, includingthe2012 -2013budgetsfor theTrafficSignalMaintenanceDistricts, withtheCityClerk'sOffice, asrequiredbySection 13.04.130oftheBakersfieldMunicipalCode; and WHEREAS, theCityClerkhasfiledinherofficeaffidavitssettingforththe compliancewiththerequirementsofChapter13,04oftheBakersfieldMunicipalCode concerningpublishingnoticeofthehearingontheTrafficSignalMaintenanceDistricts; and saidCityCouncilherebyfindsthatsaidnoticehasbeenpublishedinthemannerrequiredby law; and WHEREAS, theabovehearingwasdulyheldbytheCityCouncilatthetimeand placeforhearingproteststothefairnessofthebenefitformulas, theamountoftheassessment onanyparcelofpropertytobeassessedandthereservationbytheCityofrighttoelect whethertoproceedtoperformworkbyCityforcesorbyprivatecontractor; and WHEREAS, anywrittenprotestsfiledwiththeClerkatorbeforethetimesetfor saidprotesthearingwereconsideredbysaidCouncil, follows: NOW, THEREFOREBEITRESOLVEDbytheCounciloftheCityofBakersfieldas Theforegoing recitalsarefoundto betrueand correctand are incorporatedherein, 2. PursuanttotheprovisionsofChapter13.04ofTitle13oftheMunicipalCodeof theCityofBakersfield, thePublicWorksDirectormakesandfilesthisReportand proposedassessmentofanduponallparcelsofpropertywithinthedistrictsforthecost ofmaintainingandoperatingtrafficsignalsthatbenefitthevariousdistricts. The assessmentincludesthecosttooperate, maintain, repairandreplacesignalpoles, mostarms, signalheads, controller, cabinet, machinevisiondetectionsystem, street lightluminaries, conduits, wiresandpullboxes, costofenergy, supervisionandanyand allotheritemsnecessaryforthepropermaintenanceandoperationthereof. Developersoftenrequestpermissiontoinstalltrafficsignalsonmajorstreetsto enhanceaccesstotheirdevelopment. These "convenience" trafficsignalsarenot requiredbytheTrafficAuthoritytoregulatetrafficflow, butareinstalledsolelyatthe discretionofthedeveloperofacommercialsite, Suchsignalsdonotprovideageneral publictrafficbenefit. Underthe "userpay" concept, theprivatepropertyderivingbenefitsshouldbear thecostsofmaintenanceandoperationofconveniencetrafficsignals, OnSeptember 28, 1994theCityCouncilapprovedResolution161 -94institutingthecollectionof maintenanceandoperatingcostsoffutureconveniencetrafficsignalsthrough maintenancedistricts. Thetrafficsignalsthatareoperatedandmaintainedunderthesemaintenance districtsbenefittheparcelswithinthevariousdistricts.
