A RESOLUTION OPPOSING AB 1779 (GALGIANI)
INTERCITY RAIL AGREEMENTS - INTERCITY PASSENGER
RAIL ACT OF 2012 FOR THE SAN JOAQUIN CORRIDOR.
WHEREAS, the California Department of Transportation is currently
responsible for funding and administering the intercity rail service in the San
Joaquin Valley which is referred to as the San Joaquin Corridor; and
WHEREAS, the intercity rail service provided in the San Joaquin Corridor is a
vital component of intercity travel in the San Joaquin Valley between Bakersfield
and the Sacramento /Bay Area regions; and
WHEREAS, AB 1779 allows for the establishment of a new regional
governmental body or Joint Powers Authority to affect the transfer of all
administrative responsibilities over the San Joaquin Corridor from the
Department of Transportation to the newly formed San Joaquin Joint Powers
Authority (SJJPA) ; and
WHEREAS, the SJJPA can be established with the appointment of only 6 of
the 11 governing board members as prescribed in AB 1779; and
WHEREAS, AB 1779 includes only a three -year commitment from the State
to maintain current funding levels for intercity rail service in each corridor; and
WHEREAS, the responsibility of the SJJPA to maintain funding and service
levels beyond the three -year commitment of the state may result in a significant
liability and burden for the member agencies of the SJJPA; and
WHEREAS, the newly established SJJPA includes 11 different counties
between Bakersfield and Sacramento /Bay Area, which does not constitute local
control.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct;
2. The City of Bakersfield opposes AB 1779 (Galgiani)

Staff is instructed to prepare a letter of opposition for the Mayor's
signature.
