RESOLUTION OF INTENTION TO CLOSE
A PORTION OF 22ND STREET WEST OF
ELM STREET AND THE ALLEY RUNNING
NORTH AND SOUTH THROUGH BLOCKS
463 -A AND 463 -D, IN THE CITY OF
BAKERSFIELD, CALIFORNIA.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD,
as follows:
That it is the intention of the Council of the City of
Bakersfield to order the closing of the following described portions
of streets and alleys; and that the lands included within the
boundaries of such portions as described, be abandoned; save and
except the perpetual right and easement to use and enjoy any or all
of the property described herein, for the purpose of constructing,
reconstructing, installing, laying, maintaining or repairing the
following:
A sewer line and all of its component parts used or
enjoyed in connection therewith; also any other instrumentalities
of sanitation; also water pipes, fire hydrants and appliances for
fire protection and all appurtenances thereto belonging; also water
pipes and connections for the distribution of a domestic water supply;
also any other public system or thing and all of its component parts
which may be used and enjoyed in connection therewith, that the City
of Bakersfield may desire to place, or to have placed therein*
That the following described portion of 22nd Street be-
tween the westerly line of Elm Street and the easterly right -of -way
line of the Stine Extension Canal be closed and that the land In-
cluded within the boundaries of such portion as described be abandoned.
That the land necessary and convenient to be abandoned for
said purpose is particularly described as follows:
Beginning at the point formed by the intersection of the
westerly line of Elm Street with the southerly line of 22nd Street,
as said streets are laid down and shown on that certain map entitled,
"Map of the City of Bakersfield ", recorded in the office of the
County Recorder of Kern County, November 25, 1898; and running thence
westerly along the southerly line of said 22nd Street a distance of
two hundred nine and seventy -six one hundredths (209.76) feet to
its point of intersection with the said easterly right -of -way line
of said Stine Extension Canal, thence N 30 591 W along the said
easterly right -of -way line of said Stine Extension Canal a distance
of seventy -nine and seventy -one one hundredths (79.71) feet to an
angle point in said right -of -way line, thence N 00 201 R along said
right -of -way line a distance of two and ninety -eight one - hundredths
(2.98) feet to its point of intersection with the northerly line of
said 22nd Street, thence easterly along said northerly line of said
22nd Street a distance of two hundred fourteen and eleven one-
hundredths (214.11) feet to its point of intersection with the west-
erly line of said Elm Street, thence southerly along said westerly
line of said Elm Street a distance of eighty -two and one half (82*)
feet to its point of intersection with the southerly line of said
22nd Street and the point of beginning•
ALSO that the following described portion of that certain
alley running northerly and southerly in Blocks 463A and 463D be
closed and that the lands included within the boundaries of such
portion as described be abandoned.
That the lands necessary and convenient to be abandoned
for said purpose are particularly described as follows:
Beginning at the point formed by the intersection of the
northerly line of 22nd Street with the easterly line of the alley
running northerly and southerly in Blocks 463A and 463D, between
22nd Street and 24th Street, as 22nd Street and Blocks 463A and
463D and 24th Street are laid down and shown on that certain map
entitled, *Map of the City of Bakersfield", recorded in the office
of the County Recorder of Kern County, November 25, 1898, and run-
ning thence northerly along said easterly line of said alley to its
point of intersection with the southerly line of said 24th Street,
thence westerly along said southerly line of said 24th Street to
its point of intersection with the westerly line of said alley,
thence southerly along said westerly line of said alley to its point
of intersection with the northerly line of said 22nd Street, thence
easterly along said northerly line of said 22nd Street to its point
of intersection with the easterly line of said alley and the point
of beginning.
All of the herein proposed work and improvements shall be
done in pursuance of an act of the Legislature of the State of
California, entitled "AN ACT TO PROVIDE FOR THE LAYING OUT, OPENING,
EXTENDING, WIDENING, STRAIGHTENING OR CLOSING UP, IN WHOLE OR IN PART
ANY STREET, SQUARE, LANE, ALLEY, COURT OR PLACE NITHIN MUNICIPALITIES
AND TO CONDEMN AIM ACQUIRE ANY AND ALL LAND NECESSARY OR CONVENIENT
FOR THAT PURPOSE" approved March 6, 1889, and the several acts
amendatory thereof or supplemental thereto.
The district benefited by said closing is described as
follows: All of those portions of Blocks 461, 463A and 463D lying
without the boundary lines of the Stine Extension Canal Right -of -way,
as said portions of said Blocks 461, 463A and 463D are laid down and
shown on that certain map entitled, "Map of the City of Bakersfield ",
recorded in the office of the County Recorder of Kern County on
November 25, 1898.
The Bakersfield Californian is hereby designated as the
daily newspaper published and circulated in said City in which the
Street Superintendentts notice of the passage of this Resolution
shall be published.
I I-MREBY CERTIFY that the foregoing Resolution of Inten-
tion was passed and adopted by the Council of the City of Bakersfield,
on the .[zl. day of August, 1938, by the following vote:
