RESOLUTION 0_' TIN; COUNCIL OF TIN, CITY OF BAKERSFIELD, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE PAVING AND OTHER - WISE IMPROVING OF A PORTION OF T6VENTY- FIRST STREET IN SAID CITY IUdOWN AS '"PUBLIC IMPROVEMENT DISTRICT NO. 631 "; DECLARING THE VIORK TO BE OF MORE THAN LOCAL OR OR- DINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES THE-REOF; AND DETERMINING THAT BONDS SHALL BE IS- SUED TO REPRESENT THE UNPAID ASSESSMENTS FOR SAID COSTS AND EXPENSES, AND £FIXING THE TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK. The Council of the City of Bakersfield, California, pursuant to the provisions of the "Improvement Act of 1911 ", and amendments to the said Act, DOES RESOLVE AS FOLLCkVS: DESCRIPTION OF WORK SECTION 1. That the public interest and convenience require, and that it is the intention of the Council of the City of Bakersfield, California, to order the following work to be done, to wit: The grading and paving with asphalt concrete pave- went, construction of cement concrete curbs and gutters, construction of part circle corrugated iron and cement con- crete culverts, and appurtenant work in connection therewith in Twenty - :First Street between the east line of L Street and the east line of Q Street. GRADES The grades to which the said work shall be done and improvement made are those shown on the plans, profiles, and cross - sections herein referred to. The said plans, pro- files and cross- sections were approved by the Council of - 1 - the City of Bakersfield, California, on the 3rd day of September , 1940, and reference is hereby made to the said plans, profiles and cross- sections for a description of the grade to which said work is to be done and improvement made. PLANS, PROFILES, CROSS - SECTIONS AND SPECIFICATIONS SECTION 2: All of said work and improvement to be done shall be constructed upon the grades along, the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, pro- files and cross - sections for said improvement, known as "Public Improvement District Not 631 ", and except as otherwise provided for on said plans in further accordance with the specifications for said improve- ment, which said plans, profiles, cross - sections and specifications heretofore approved by the Council of the said City, are on file in the Office of the City Clerk of the said City and of the City Engineer there- of, and reference is hereby made thereto for a further, full and more particular description of the said work, and by reference thereto the same are incorporated herein and made a part hereof* D%sSCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the said contemplated work and improvement, in the opinion of the said Council, is of more than local or ordinary public benefit, and said Council hereby makes the expenses of a portion of - 2 - of said work and improvement chargeable upon a district, which said district, said Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay a portion of the costs and expenses thereof, and which dis- trict is bounded and described as follows, to -wit; Beginning at a point on the east line of L Street, distant thereon 115.50 feet northerly from the north line of Twenty -first Street; then easterly along a line parallel with the northerly line of Twenty -first Street to the west line of M Street; thence easterly in a direct line to a point on the easterly line of M Street, distant thereon 122 feet northerly from the northerly line of Twenty -first Street; thence easterly along a line parallel with the northerly line of Twenty -first Street to the west line of N Street; thence easterly in a direct line to a point on the easterly line of N Street, distant thereon 116.25 feet northerly from the northerly line of Twenty -first Street; thence easterly along a line parallel with the northerly line of Twenty -first Street to the west line of P Street; thence easterly in a direct line to a point on the east line of P Street, distant thereon 122 feet northerly from the northerly line of Twenty -first Street; thence easterly along a line parallel with the northerly line of Twenty -first Street to the east line of Q Street; thence southerly along the east line of Q Street to a point distant 122 feet southerly from the southerly line of Twenty- - 3 - first Street; thence westerly along a line parallel with the southerly line of Twenty -first Street to the east line of P Street; thence westerly in a direct line to a point on the westerly line of P Street dis- tant thereon 115.25 feet southerly from the southerly line of Twenty -first Street; thence westerly along a line parallel with the southerly line of Twenty -first Street to the east line of N Street; thence westerly in a direct line to a point on the west line of N'Street, distant thereon 122 feet southerly from the southerly line of Twenty -first Street; thence westerly along a line parallel with the southerly line of Twenty -first Street to the east line of M Street; thence westerly in a direct line to a point on the west line of M Street, distant thereon 115.5 feet southerly from the southerly line of Twenty -first Street; thence westerly along a line parallel with the southerly line of Twenty - first Street to the east line of L Street; thence northerly along the east line of L Street to the point of begin- ning, excepting therefrom all public streets and alleys. Reference is hereby made to a Map, consisting of two (2) sheets attached to and forming a part of the written report filed July 8, 1940, under the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", for a further, full and more particular description of the said assessment district, and the said map or plat so on file shall govern for all details as to the extent of the said assessment district. DESCRIPTION OF BONDS. SECTION 4. Notice is hereby given that serial -4- bonds to represent unpaid assessments and to bear interest at the rate of five per cent (5 %) per annum shall be issued hereunder in the manner provided in the "Improvement Bond Act of 191511, approved June 11, 1915, and all acts amendatory thereof, the last installment of which bonds shall mature four (4) years from the second day of July next succeeding ten (10) months from their date. PORTION OF COSTS AND EXPENSES TO BE PAID BY THE CITY OF BAKERSFIELD, CALIF. SECTION 5. Notice is hereby given that the Council of the City of Bakersfield has determined that the City of Bakersfield will, out of its "Gas Tax Fund for Streets of Major Importance" pay the sum of $15,600, and will, out of its "Street Improvement Fund ", pay an additional sum of $400.00 toward the costs and expenses of said improvement; the liability and obligation to pay such sums so provided herein shall accrue and become fixed upon the date of the confirmation of the assess- ment by the Council of said City. TIME AND PLACE OF HEARING. SECTION 6. NOTICE IS HEYEBY GIVEN that on the y day of � 1940, at the hour of eight (8) o'clock P. M., in the Council Chamber of the City Hall, in the City of Bakersfield, California, any and all persons having any objections to the proposed work or improvement, or to the extent of the assessment district, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this resolution of intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. -5- PUBLICATION OF RESOLUTION OF INTENTION. SECTION 7. "The Kern Herald ", a daily news- paper of general circulation, printed and published in the City of Bakersfield, California, is hereby designat- ed as the newspaper in which this Resolution of Inten- tion shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the proceedings under this Resolu- tion of Intention. The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for city taxes, all in the manner and form provided for under Section 5 of the "Improvement Act of 1911" herein referred to. POSTING OF NOTICE OF IMPROVEMENT. SECTION 8. The Street Superintendent of the City of Bakersfield, California, shall cause to be con- spicuously posted along the line of said contemplated work or improvement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention in the time, form and manner provided by law. IMPROVEMEivT ACT. SECTION 9. That all of the work herein pro- posed shall be done and carried through in pursuance of an Act of the Legislature of the State of California, designated the "Improvement Act of 191111, approved April 7, 1911, and all acts amendatory thereof, except -6- that bonds shall be issued in accordance with the "Im- provement Bond Act of 1915" as herein provided, REPORT. SECTION 10. That the written report of the City Engineer on the construction of the improvements as proposed, prepared pursuant to the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", as amended, is on file in the Office of the City Clerk of said City and open to public inspection, reference to which is hereby made for particulars, ------ 000 - - - - -- I HEREBY CERTIFY that the foregoing Resolution of Intention was passed and adopted by the Council of the City of Bakersfield, at a regular meeting thereof held on thewW_rlay of _. , 1940, by the following vote: AYE5,80DEX,MARMADUItE; 0RR[S,8MiT"0LLER8,W1L50X ROES :.
