HomeMy WebLinkAboutROI NO 0635RESOLUTION OF INTENTION NO. (° 3S RESOLUTION OF INTENTION TO CLOSE. A PORTION OF THE ALLEY IN BLOCK 180 GODEY TRACT, IN THE CITY OF BAKERSF`IELD, CILIFORNIA. BE IT RESOLVED BY THE COUNCIL OF THE' CITY OF BAKERSFI111), as follows: That it is the intention of the Council of the City of Bakersfield to order the closing of that portion of an alley herein described; and that the lands included within the boundaries of such portion, as described be abandoned; save and except the perpetual right and easement to use and enjoy any or all of the property described herein, for the purpose of constructing, reconstructing, installing, laying, maintaining or repairing the following: A sewer line and all of its component parts used or enjoyed in connection therewith; also any other instrumentalities of sanitation; also water pipes, fire hydrants and appliances for fire protection and all appurtenances thereto belonging; also water pipes and connections for the distribution of a domestic water supply; also any other public system or thing and all of its component parts which may be used and enjoyed in connection there- with, that the City of Bakersfield may desire to place, or to have placed therein. All of that portion of the alley, running easterly and westerly, through that portion of Block 180 of the Godey Tract lying easterly of Golden State Avenue, as said Godey Tract is laid out and shown on a map entitled "Plat of the Godey Tract ", filed October 10, 1892, in Asap Book 1, page 33, in the office of the County Recorder of Kern County, California, and as said Golden State Avenue was established by Decree of Condemnation had in Case No. 25454, in the Superior Court of the State of California, in and for the County of Kern, a certified copy of which Decree was recorded January 17, 1933, in Book 451, page 467, of Official Records, in the office of the County Recorder of said Kern County. All of the herein proposed work and improvement shall be done in pursuance of an act of the Legislature of the State of California, entitled "AN ACT TO PROVIDE FOR THE LAYING OUT, OPENING, EXTENDING, WIDENING, STRAIGHTENING OR CL08ING UP, IN WHOLE OR IN PART, ANY STREET, SQUARE, LANE, ALLEY, COURT OR PLACE WITHIN MUNICIPALITIES AND TO CONDEMN AND ACQUIRE ANY AND ALL LAND NECESSARY OR CONVENIENT FOR THAT PURPOSE" approved March 6, 1889, and the several acts amendatory thereof or supplemental thereto. The district benefited by said closing is described as follows: All of that portion of the above mentioned Block 180 of the Godey Tract lying easterly of the above mentioned Golden State Avenue.
