HomeMy WebLinkAboutROI NO 0642aESOLUTIOIT OF INTENTION N0. 6�� IWOLUTION OF INTENTION TO CLOSE A CERTAIN PORTION OF JAMES STI T IN THE CITY OF BAnRSFIELD, CALIF'ORNIA. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BLQi RSFIILD, as follows: That it is the intention of the Council of the City of Bakersfield to order the closing of that portion of James Street herein described; and that the lands included within the boundaries of such portion, as described, be abandoned; save and except the perpetual right and ease- ment to use and enjoy any or all of the property described herein for the purpose of constructing, reconstructing, installing, laying, maintaining or repairing the following: A sewer line and all of its component parts used or enjoyed in connection therewith; also any other instrumentalities of sanitation; also water pipes, fire hydrants and appliances for fire protection and all appurtenances thereto belonging; also water pipes and con- nections for the distribution of a domestic water supply; also any other public system or thing and all of its component parts which may be used and enjoyed in connection therewith that the City of Bakersfield may desire to place or to have placed therein. All of that certain portion of James Street, as named and described in Ordinance No. 198, Now Series of the City Council of the City of Bakersfield lying between the Northerly line of 24th Street and a line 17.55 feet Easterly from and parallel with the Easterly line of "T" Street as said 24th Street and 'IT" Street are shown and delineated upon a Map of the City of Bakersfield, recorded November 25, 1898, in Book 1 of Maps at pages 13 and 14, Records of Kern County, California, said "' "' Street having been vacated by Resolution of the City Council of the City of Bakersfield, adopted "November 26, 1923, the land to be vacated being more particularly described as follows: 1. Beginning at a point in the Southerly line of the said James Street distant 17.55 feet from and measured at right angles with the Easterly line of the said "T" Street; thence Northerly and parallel with the Easterly line of "T" Street to the Northerly line of James Street and the Southerly right of way line of Southern Pacific Company's Main Line right of way; thence Southeasterly along the northerly line of James Street and the Southerly right of way line of the Southern Pacific Company's Main Line right of way to the Northerly line of the said 24th Street; thence Viesterly along the Northerly line of 24th Street to the Southerly line of James Street; thence Northwesterly along the Southerly line of James Street to the place of beginning. All of the herein proposed work and improvement shall be done in pursuance of an act of the Legislature of the State of California, entitle "AN ACT TO PROVIDE; FOR THE LAYING OUT, OPENING, EXTENDING, CWIDENING, STRAIGHTENING OR CLOSING UP, IN WHOLE OR IN PART, ANY STREET, SQUARE, LANE, ALLEY, COURT OR PLACE WITHI!j MURICIPALITIES AIM TO COINDEi: N AND ACCUIHB ANY AND ALL LAND iMCESSARY OR COilVE141EXT nR THAT PURPOSE ", approved March 61 1889, and the several acts amendatory thereof or supplemental thereto. The district benefited by said closing is described as follows: All of Fractional Blocks 136 and 137 including the alley in Block 136, vacated by Resolution of the City Council of the City of Bakers- field, adopted September 11, 1939, the adjacent and contiguous portion of "U" Street vacated by Resolution of the City Council of the City of Bakersfield, adopted April 21, 1924, and the adjacent and contiguous portion of James Street all as shown and delineated on Map of the City of Bakersfield, recorded November 25, 1898, in Book 1 of daps at pages 13 and 14, records of Kern County, California. The Bakersfield Californian is hereby designated as the daily news- paper published and circulated in said City in which the Street 2.
