HomeMy WebLinkAboutROI NO 0645RESOLUTION OF INZITION NO . A RESOLUTION OF INTENTION TO CLOSE A PORTION OF 10th STREET IN THE CITY OF BAKERSFIELD, CALIFORNIA. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows: That it is the intention of the Council of the City of Bakers- field to order the closing of that portion of 10th Street herein described; and that the lands included within the boundaries of such portion, as described, be abandoned; save and except the perpetual right and easement to use and enjoy any or all of the property described herein for the purpose of constructing, reconstructing, installing, laying, maintaining or repairing the following: A sewer line and all of its component parts used or enjoyed in connection therewith; also any other instrumentalities of sanitation; also water pipes, fire hydrants and appliances for fire protection and all appurtenances thereto belonging; also water pipes and connections for the distribution of a domestic water supply; also any other public system or thing and all of its component parts which may be used and enjoyed in connection therewith, that the City of Bakersfield may desire to place, or to have placed therein. All that portion of 10th Street lying between the Easterly line of Pershing Street and the Westerly line of Union Avenue, as said streets are shown and delineated on map of California Park Tract No. 2, re- corded March 30, 1925, in Book 3 of Maps at Page 115, Records of Kern County, California. All of the herein proposed work and improvement shall be done in pursuance of an act of the Legislature of the State of California, entitled "AN ACT TO PROVIDE FOR THE LAYING OUT, OPENING, EXTENDING, WIDENING, STRAIGHTENING OR CLOSING UP, IN WHOLE OR IN PART, ANY STREET, SQUARE, LANE, ALLEY, COURT OR PLACE WITHIN MUNICIPALITIES AND TO CONDEMN AND ACQUIRE ANY AND ALL LAND NECE68ARY OR CONVENIENT FOR THAT PURPOSE ", 1. approved March 6, 1889, and the several acts amendatory thereof or supplemental thereto. The district benefited by said closing is described as follows: Lots 6 to 15 inclusive, Block 1, and Lots 1 to 6 inclusive, and 17 to 22 inclusive of Block 2, and all of Blocks 5 and 9, in California Avenue Park Tract No. 2, recorded march 30, 1925, in Book 3 of daps at page 115, Records of Kern County, California. The Bakersfield Californian is hereby designated as the daily newspaper published and circulated in said City in which the Street Superintendent's notice of the passage of this Resolution shall be published.
