(.57.5' A RESOLUTION OF THE COUNCIL OF THE CITY OF B.AMRSFIELD, CALIFORNIA DECLARING ITS INTENTION TO ORDER THE VACITION OF A POR- TION OF EUREKA STREET AND THE .ALLEY IN BLOCK 144 IN THE CITY OF BAKERSFIELD, CALI- FORNIA. The Council of the City of Bakersfield, California, pursuant to the provisions of the "Street Vacation Act of 1941," being Divi- sion 9 of the Streets and Highways Code of the State of California, does hereby resolve as follows: ,5`gct on 1: That it is the intention of the Council of the City of Bakersfield, California, to order the vacation of a portion of Eureka Street and an alley in Block 144 within said City, to wit: All that portion of Eureka Street lying between the Easterly line of Sonora Street and the Westerly line of Inyo Street; also the alley running easterly and westerly through Block 144, Kern, as said street and alley are shown and delineated on Asap of Bakersfield, Kern County, California, recorded January 12 1889 in Book 1 of Maps at pages 15 a;2 16, Aecords of Kern County, California; reserving and excepting from said vacation, the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across the street and alley proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental 1. purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street and alley proposed to be vacated. That it is determined by the Council of the City of Bakers- field that the public convenience and necessity require the reserva- tion of said easements and the proceedings hereunder are taken subject to such reservations and exceptions. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of the City of Bakersfield, in the City Hall, Bakersfield, California. Section 2: That the hour of 8 o'clock R. PY., of the 8th day of April, 1946, in the Council Chambers in the City Hall, Bakersfield, California, be and the same is hereby fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the Council and offer evidence in relation thereto. Section 1: That the Superintendent of Streets of the City of Bakersfield, California, be and he is hereby directed to cause "Notice of Street Vacation" to be posted as required by the said "Street Vacation act of 19411" being Division 9 of the Streets and Highways Code of the State of California; and the Council of said City hereby elects to proceed under the provisions of said .Act. Section 4z The City Clerk shall certify to the passage of this Resolution, and shall cause the same to be posted on the bulletin board at the City Hall of said City within fifteen (1 5) days after its passage. - - - -- 000 - - - -- 2.
