HomeMy WebLinkAboutROI NO 0657RESOLUTION OF INTE1srION No. 657 A RESOLUTION OF THE COU14CIL OF TI-M CITY OF B.AKERSFIELD CALIFORNIA DECLARING ITS INTENTION TO OADER THE VACITIOiJ OF PORTIONS OF VIRGINIA STREET, WILLIAMS STREET, EUREKA STREET EAST 18TH STREET EAST 19TH STREET, AND Fih ADJOINING ALLEYA, IN THE CITY OF RARERSFIELD, CALIFORNIA. The Council of the City of Bakersfield, California, pursuant to the provisions of the "Street Vacation Act of 1941," being Divi- sion 9 of the Streets and Highways Code of the State of California, does hereby resolve as follows: Section 1: That it is the intention of the Council of the City of Bakersfield, California, to order the vacation of portions of certain streets and alleys in the City of Bakersfield, more particularly described as follows; All that portion of Virginia Street and also all that portion of Williams Street that lies be- tween the south line of Truxtun Avenue and the north line of California Avenue. All that portion of Eureka Street and of 18th Street and of 19th Street that lies between the east line of Brown Street and the west line of Virginia Street. All alleys that lie within the area that is bounded on the east by the west line of Virginia Street, on the west by the east line of'Brown Street, on the north by the south line of Truxtun Avenue on the south by the north line of California Ivenue, together with the alley in Block 212 as said block is shown on map entitled, "Bakersfield, Formerly Sumner," recorded in Map Book No. 1, Pages 19 and 20; reserving and excepting from said vacation, the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across the streets and alleys proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, 1. wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its'products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the streets and alleys proposed to be vacated. That it is determined by the Council of the City of Bakersfield that the public convenience and necessity require the reservation of said easements and the proceedings hereunder are taken subject to such reservations and exceptions. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of the City of Bakersfield, in the City Hall, Bakersfield, California. Section 2: That the hour of 8 o'clock P. M., of the 5th day of .August, 1946, in the Council Chambers in the City Hall, Bakersfield, California, be and the same is hereby fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the Council and offer evidence in relation thereto. Section 1: That the Superintendent of Streets of the City of Bakersfield, California, be and he is hereby directed to cause "Notice of Street Vacation" to be posted as required by the said "Street Vacation Act of 1941," being Division 9 of the Streets and highways Code of the State of California; and the Council of said City hereby elects to proceed under the provisions of said .Act. Section 4: The City Clerk shall certify to the passage of this Resolution, and shall cause the same to be posted on the Bulletin Board. at the City Hall of said City within fifteen (15) days after its passage. - - - - -- 000- -- - - -- 2.
